Hi All,

It's been a while since I had to write to you. I do check on what is going on periodically and I must say I hate the fact that I'm here again having to go through yet another process. :crying: I can't wait when all of this will be over and there will be no more cost or stress and tension. The only positive thing about this whole process is that my love is here with me and not in his country waiting for me. (L):ot2:

We are getting ready to file and have Radu's conditions remove. A friend of mine who became a U.S. Citizens about 2 years ago told me that Radu can apply for his Citizenship 6 months before our 3rd year anniversary even if his conditions are not yet remove.

Can anyone elaborate a little on this and tell me if this is true because if it is so, we can start that process in July. :dance:

You must meet three tests to become a citizen based on marriage

* Three full years married to and living with a US Citizen spouse

* The spouse must have been a US Citizen for three full years

* Three years continuous residence in the US with a green card.

You can send the paperwork in 90 days before meeting the "three years continuous residence" requirement, provided you meet the other two requirements on the day of filing. But you can't actually take the oath of citizenship until all three requirements are met for three full years.

See the box at the bottom of page 22 of the M-476 for details. While you're there, read the rest of the M-476. It's got lots of good info.

The three requirements may be met in any order. For many people, especially those who went through some sort of adjustment of status, the "three years less 90 days of continuous residence" is the last one to be met, so many people can file one year after they file for removing conditions. But if you came here on a CR-1 visa, the "three full years married to and living with a US Citizen spouse" might be the last requirement to be fulfilled. And if you married an alien who became naturalized shortly after you married, the "Spouse must have been US Citizen for three full years" could be the one that determines your filing date.

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

based on marriage, you apply for removing condition 90 days before second anniversary of the green card issuing date and 90 days before 3rd anniversary for citizenship.

To clarify, based on marriage, you MUST apply for removing condition between 90 days before second anniversary of the green card issuing date and the actual anniversary.

you MAY apply for citizenship anytime after 90 days before 3rd anniversary of the green card issuing date (provided you also meet other requirements).

Feb 7, 2008 - fingerprints done (took about 10 min - as a walk-in)

Sept 8, 2008 - Interview date (letter received Jul 18) - rescheduled at my request

Jan 6, 2009 - Interview date

Feb 26, 2009 - Citizenship Oath

*online status "case received Oct 29", no touches showing.
