My wife got a DWI (less severe than DUI but still a driving while intoxicated charge) while on her student visa 4 years ago. Because of that I am confused on how to answer these questions:

For questions 30.b- do I check yes or no for "moral turpitude violation of any law involving controlled substance".

31.Have you ever been charged, arrested, convicted of any offense or crime?

I assume the answer would be yes for this as she was arrested and finally charged with the DWI. However is the DWI an offense or a crime? If it is, what is the best way to answer? Simply answer yes and explain the rest of the details in the interview or answer yes and provide as many details as possible on DS-230?

Thanks for the help, it feels so good to be on the home stretch for our visa! I hope only a couple more months until I rejoin my wife and baby again.

Yes, a DWI is an offense and therefore she needs to check yes. She could also write a letter explaining the offense so to give the NVC and the CO a heads up about it before the interview.

It's important she answer yes and offer and explanation. They already know the answer.

Thank-you for the help.

I will plan to check yes to question 30.b and answer 31 yes. For the explanation to the offense I will write 'please see attched note' in 31 and then write a letter explaining the situation written from my wife with me helping her to correct grammer where needed making it more formal. From here I assume I need to provide good evidence as to why this is not a problem for my wife come the interview.
