My husband is a US citizen, but he also holds Croatian citizenship. Although he's been residing in the US (for the last 4 years), he spent most of his life in Croatia, and we were wondering whether our case would be eligible for DCF?

10/22/2008 married in New York (spouse left the country afterwards)

01/15/2009 sent I-130 package to Chicago Lockbox (spouse back to the US on a tourist visa issued earlier in 2008)

01/17/2009 package arrived at Chicago Lockbox

01/26/2009 received a return receipt from Chicago Lockbox

01/28/2009 moneygrams order cashed

02/16/2009 still waiting for NOA1....

i could be wrong on this but i believe in order to be eligible for DCF he must have been currently residing in Croatia for at least 6 mos

wizardfitz is correct, your USC has to be legally residing in the country in question for 6 months before you can file DCF. Of course this is easy for a dual citizen as he won't need a visa or "green card" for the country, but he'll still need to establish legal residency there (rent or buy a home etc).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

OK, so it must be six months immediately prior to filing or 6 months at any time? I am asking because he spent most of his life in Croatia and established the US residency again four years ago.

let me put it this way, if he files for DCF now, he must be living in Croatia now and has been for at least 6 months

the operative word here is "currently residing"
