Married or not married??

Timeline

Me and my boyfriend have been living together for almost 4 yrs (this yr in Sept)we got engaged in 05' but never got married,now we have a little girl who is turning 3 this yr and i really want to get married so we can have a better furture. He is not a us citizen he came here illegaly but i'm hopeing that we can get married with no problem,meaning that we have to live in his country for along time or for him to leave for a long time.Alot of people have told us to go back to his country an get married over, that it would be faster for him to get a green card.We went to a lawyer last yr an told us to wait these yr to see if there are new laws coming in and maybe just pay a fine in his situation. We are living together but does it count like being married or not?? For ex, if we get married tomorrow and we go an apply for him to get his papers can we add to the application tha we have been married 4 yrs??

I'M NEW TO THIS SITE ANY ANSWER WOULD BE THANKFUL

The government is only interested in legal marriage, so you are not married till you are legally married with a marriage certificate.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
