Hey,

I'm in the process of filling out I-130 for my wife. I'm confused about under what name should I file her case.

My wife is in the process of changing her last name over to mine but our marriage certificate has her maiden name is listed.

Should I file I-130 under the new name or her maiden name (listed on our marriage certificate)?

Hey,

Use here current legal name. If her name changed or is in the process of changing due to marriage, file in the married name. She needs a new passport too, if that's the case.
