:huh: i dont know what to put in my fathers(beneficiary) marital status in the DS230. He lives in the Philippines but he's divorced here in the US(never been here in the US). I put divorced in the I130 and it got approved. He will be interviewed in the Philippines where there is no divorce but its going to be at the Manila US Embassy. So if I put divorced I think the people in the US Embassy should have the knowledge about divorce here and there. :wacko::( but I don't know....what do you think guys??? anybody who has idea?? mga pinoys?? help........................pls................ :):innocent:

????? Dont understand what you are trying to ask? He is either married, divorced, single (never married) or widowed.

I take it his wife came to the USA without him and subsequently divorced him. He could register the divorce in the Philippines but I dont think it would be neessary. He should have a copy of the American divorce to take with him to the interview just in case there are any questions.

you're right. my mom came here and divorced him. I think I'll just put "divorce". He has all the papers and he's really divorced anyways. One more thing he's dealing with the US so I think he should follow the rules where he is trying to go, right?? anybody?? tell me im right............. :unsure:

The US embassy will not have a record of your dad's divorce. It is your burden to produce the record, not theirs to go find. If you don't give them a copy, it may delay his case because his application shows that he is divorced and he has no supporting record.

You need to get the US embassy a copy of the divorce decree.

My father has the divorce decree and I included a copy of it with the I130. It got approved so thats not a problem anymore. my problem is, filling up the DS 230, which is the biodata of the beneficiary. My father believes that since he is the one filling up the document, it would be better to put "married" instead of divorce. I tried talking to him about putting "divorce" but he is insisting that it should be "married". "He said" that he is in the Philippines and Philippines do not have divorce nor do not recognize divorce therefore he's marital status is "Married". I don't know how else to explain it to him. Like what I said he has all the papers and if they question him he can just show the divorce decree. It is certified and it is not like we just made it just for $h!ts and giggles. :crying: thanks!

If he refuse to sign, then his application will be abandoned. He will be stuck in the Philippines.

If you put married and he signs, the US embassy will red flag that issue and he will have to give them an answer as to why there is a discrepancy. I suggest you write a letter explaining the situation to the embassy. Tell them that he considered himself married because he does not believe in divorce even though his wife received a divorce decree in the US with him in abstention.

Good luck when he gets here because your father seems very stubborn even though he knows very little about US laws and how things work here. He has to adapt to life in the US. Our rules are different from the Philippines and he has no choice but to follow the rules here. Doing it the Filipino way will not excuse him from following US laws. Sorry for the digression.

he doesnt trust me. he said he's going to need to talk to some lawyers about it. i dont know......im starting to think he still cannot accept that he's divorced with my mom. but anyways, he's going to sign the divorced one wether he likes it or not( its bec im his boss....lmao.....jk.....)
