applying for K-3 - where to send I-129F

Timeline

Hello friends,

I have filed I-130 petition on February 21, 2008. received NOA from Vermont Service center.

On Nov 6, 2008 , this petition transferred to California Service center and it is still pending.

California service center transferred to local district office Newark, NJ for standard interview.

Now I am thinking to apply for K-3. and I need to send I-129F.

Do I need to send I-129F to Vermont service center or California service center?

Please let me know.

I-130 Timeline:

Feb. 14, 2008 -- I-130 Sent to USCIA-Chicago Lockbox - filed for spouse based on greencard

Feb. 21, 2008 -- NOA 1 Received from VSC

Aug. 22, 2008 – Become US citizen, called USCIS to upgrade I-130 from F2A to CR1-IR-1 category

Aug. 23, 2008 – send a letter with copy of certificate of naturalization to upgrade the petition.

Sept. 22, 2008 – Status is upgraded to CR-1/IR-1 category and case is pending.

Nov. 06, 2008 - Transferred to CSC (notified via US Post)

April 02, 2009- NOA2 - approval notice sent

NVC Journey

2009-04-17 : Case Number Assigned - Received this by speaking to a live operator.

2009-04-20 : AOS and IV Fee bills generated and rec'd Invoice id number via e-mail

2009-04-22 : AOS and IV Fee bills status - Paid (online)

2009-04-24 : AOS and DS-230 package sent to NVC

2009-05-06 : case completed at NVC (checked through AVR)

Embassy Journey

2009-05-12 : Forward the case to Embassy in Mumbai (BMB) India

2009-06-30 : Visa Interview

2009-xx-xx : Medical

2009-xx-xx : Visa Approved

2009-xx-xx : Visa in Hand

2009-xx-xx : POE

per the instructions:

If you are filing an I-129F petition for your spouse, mail your petition to the Service Center where the underlying I-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F.

I wouldnt go filing for the k3 just yet.

Find out why its been sent to your local office for an interview. They want to interview you, the petitioner?

I wouldnt do anything until I found out what the next move is in regards to that interview, it may delay things even further

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Find out why its been sent to your local office for an interview. They want to interview you, the petitioner?

I agree. I would generally advise against filing an I-129F anyway and certainly not three months after the I-130. Transfers to local offices for standard interviews are not common but they do happen. They indicate USCIS wants a face to face interview to further investigate either the petitioner's immigration past, their legal status or the bona fides of the relationship.

It costs no money but when the I-129F gets to VSC, they'll need to marry it up with the I-130 that will be who knows where by that time. Once the get the two petitions together, the I-130 will take it's place about three months farther back in line, with the I-129F. There are more costs than money and the problems with the I-130 will not be solved with an I-129F.

Facts are cheap...knowing how to use them is precious...

right. at this point, sending in the 129f will only delay the underlying 130. also, the OP has an interview at his local office. He needs to adress this first.

130's are being approved WAY faster than k3's at this point

Im not trying to argue or be a brat :P but...I really dont understand what you mean in the statement above?

The 130's(CR1's/IR1's) are being approved MUCH faster than k3's. IF one files a 129f MONTHS after the 130, USCIS had to pull the 130 from its "place in line" and stick it to the back of the k3 line..why would one want to do that with the knowledge that 130's are being approved faster?

it's not really a "different channel of processing". The 129f will be "tied" to the underlying 130, hence making it a k3.

Nom, they do not take two different channels of processing. They used to but that ended more than two years ago. Once an I-130 is approved, an I-129F cannot be approved. They've been putting the two petitions together since November, 2006. The exception is when the I-129F is filed too much later than the I-130, then they just approve the I-130 and the I-129F is denied due to the fact there is no longer a pending I-130 for the beneficiary.

Whatever the reason for the standard interview, it will not be bypassed by filing an I-129F. The two petitions now end up on the same adjudicator's desk. They've been doing that for over two years now. You'd be a fool to file the I-129F, IMO.
