Since her children were under 18 when she married the USC, her husband can petition them as their step-father. All he has to do is file form I-130 and that's it. It should take about 12 months or so.

In 2007 it took about 60 plus days to get our I-130 approved at the USCIS level, then on to the NVC the case goes, cases are going a lot faster now due to the shortcuts and ability to pay on line, why would 12 months be out of the question? Is it not better to expect a little more time and when they arrive quicker be happier? Or would people prefer someone to say it will take 6 months and then it takes 12 and they are devestated? It took us without shortcuts about 9 months to get the kids here as I ( USC ) petitioned them. We had 1 RFE at the NVC level. Make sure ducks are in a row and maybe it will take less, but however sometimes it takes a lot longer even for Children.,

what if he is the biological son of the USC? and could not satisfy one requirement to automatically give the US citizenship? how long would that take?

If this was the USC father's biological child born in a foreign country, the father would need to register the child's birth at a US embassy or consulate before the child's 18th birthdate to confer US citizenship to the child. The child would be issued a US passport and travel to the US immediately as a US citizen. The time it takes depends on the embassy/consulate. I have read on this board and other boards that it can take a few days to a few weeks to get the passport.
