Hi, guys! I just wanna asks about the case of my friend, filed for K-VISA. I was trying to help her and lessen her heartaches about their case. So, I am here asking your help in her behalf. Last Jan. 30, they received this notice:

" On January 30, 2009, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 30 days of the January 30, 2009, please call customer service at 1-800-375-5283 for further assistance" .

We are quite anxious about the statement above since they haven`t received yet the formal letter from USCIS explaining about their denial and what be their options.

If in case you know about some options about their case, kindly share us about it. They are thinking for an alternative solutions and options but the letter was not in their hands yet. I believed in their genuine love it just that this situation happened.

Any opinions and suggestions will do just to let them know what would be their options. They just want to have an idea about the possible options before they can get the letter. Thank you and God bless!

Any idea why they were denied? They should wait for the denial letter, that will let them know what is the reason for denial. Once they know that, an alternative plan of action can be formulated. There could be various reasons for the denial, and they have a bearing on what they can do next.

Reasons for K1 denial are always very clear.

Some clear reasons:

1. The petitioner is either not a USC or has not provided adequate evidence that they are.

2. The petitioner and beneficiary have not met in person within the preceding 2 years or have not provided evidence that they did.

3. The petitioner is not free to marry or has not provided evidence that they are.

4. The petitioner has too many prior petitions and has not requested a waiver or the waiver was not granted.

More details regarding this case need to be provided to make any conclusions regarding possible reasons for the denial.

First they have to say reason, is it something can be fixed? something that will never change? etc if can be fixed, then try to resolve issue and can refile. If some things cant be fixed or changed then you have to consider are these things so bad that even if refile they will always be deny. Just depends on situation

Yes, like a timeline and you say K visa. Is it K1 or K3?

The denial letter will make things clear but the above are things to think about. Both must be free to marry, have seen each other in person in the last two years, paid the correct fee, all required forms were submitted and complete and the petitioner has provided evidence of US Citizenship. Any of those missing would result in a denied petition.

I would also add....

To get a petition denied, it has to be something very fundemental in the process. If there is a deificiency, they would have sent an RFE asking for the missing evidence. If you ignore the RFE, then you will de denied.

I would think that they already know the reason, unless they committed fraud by sending in fake documents.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

when did they file? did they receive any notice of actions before they got this notification? what stage are they in already? USCIS, NVC or were they interviewed already?

I called the customer service number in the denial letter and it was a letter from the USCIS. They were denied very early on before it got to the NVC or the consulate.

Can't help at all unless we know what the reasons were for denial. It could be minor like missing paperwork, lack of fee, etc, to major that a background check showed it to be ineligible.

Looks like it was the petition....if they were in the interview process it would have said visa.

They were denied by the USCIS? Or by the US Embassy in Manila? Did they get to have an interview with a consul?

yea they wont deny over lack of fee...they will just send the packet back and adv they can not process the petition until the correct fee is sent.

yup, cannot deny until a submission has been accepted for processing, cannot accept for processing until proper fee payment has been tendered
