Questions about DCF, paperwork, etc

Dear VJ members,

For those of you who have experience with the DCF process and paperwork, can you please help me?

In the DS-230 form:

1. Question 11 asks where you want the Green Card sent if different from Question 10 (permanent/temporary address). What should you enter if it's the same as in Question 10: 'Same,' 'N/A,' or just write the address again as in Question 10?

For some reason, N/A doesn't seem correct in this case and I know they can be picky about these things.

2. Section 14 asks for Address of Spouse (myself) if different from your own. What should we put there if we live together?

3. Question 20 asks for places where lived and requests City/Town and Province. Do they not want a street address for each place you've lived?

4. Question 22 asks for history of employment. Under the Location column, do you put the street address or just the city and county?

For the DS-2001 form which requests Evidence of Support, is that just the I-864 affidavit of support?

Regarding the I-864 affidavit of support:

1. In Question 13, what do I enter as Place of Residence (if different from mailing address in Question 12) if it's actually the same?

2. In Question 15, what do I enter as the domicile? I think it's USA but just want to confirm.

3. Question 21 asks for the household size but to not count anyone twice. Unfortunately, 21a says to enter the number I entered in Question 10 (total number of immigrants you are sponsoring on this form, so in my case, just 1 - my wife), then 21b has the number 1 for myself, then 21c says to enter 1 if currently married which brings my total household size in 21h, adding the lines in 21, to 3 people which is not correct. How do you enter this field correctly?

Another VJ member has suggested that I enter 21c as 0. What did you do that worked when sponsoring only your wife/husband?

4. In Question 25, I'm entering my adjusted gross income (AGI) for 2007, 2006, and 2005 since I haven't done my 2008 taxes yet. Is that OK?

5. Also in the same question, my 2007 is really low (less than $1000) because I took the foreign earned income exclusion and housing deduction. Will that be a problem? The rest of my tax return shows significantly higher wages though before the exclusions are taken in my return.

Thanks in advance for your help.

Dear VJ members,

In the DS-230 form:

1. Question 11 asks where you want the Green Card sent if different from Question 10 (permanent/temporary address). What should you enter if it's the same as in Question 10: 'Same,' 'N/A,' or just write the address again as in Question 10? I would write the same address, and indeed, do not write N/A.

For some reason, N/A doesn't seem correct in this case and I know they can be picky about these things.

2. Section 14 asks for Address of Spouse (myself) if different from your own. What should we put there if we live together? Since you are doing DCF, it is obvious you share address, so just repeat it. The stupid forms were not designed with us DCFers in mind <_<

3. Question 20 asks for places where lived and requests City/Town and Province. Do they not want a street address for each place you've lived? Answer what is asked - this will also be covered in your police certificates. I wrote done city/province/country and was ok

4. Question 22 asks for history of employment. Under the Location column, do you put the street address or just the city and county? In this one I did put the whole address.

For the DS-2001 form which requests Evidence of Support, is that just the I-864 affidavit of support?

Regarding the I-864 affidavit of support:

1. In Question 13, what do I enter as Place of Residence (if different from mailing address in Question 12) if it's actually the same?

Ahlpo,

Why were you asked for an interview at the US embassy in London?

What sort of questions were you asked?

Thanks

It was to prove that my wife and I did indeed have a bona fide marriage. We were expecting a Stokes interview which is where they separate you and ask you the same questions to compare answers. Whilst that was indeed the case, we were way over-prepared but glad to be ready.

We brought a copy of our joint lease, proof of joint bank accounts, insurance forms with her designated as my beneficiary, photos, notarized affidavits from friends and family, photos, email exchanges, letters and cards from family/friends, and a whole bunch of things we collected throughout our relationship.

The immigration officer was actually really pleasant. He interviewed my wife first and asked her things like where and how we met, where we've traveled together, when she met my family, etc... The he questioned me and asked some of the sames questions but a lot were complimentary to our story. He asked where we got married, how well I knew my wife's family, etc...

Before questioning us separately though, he asked if we had any documents to support our case so we gave him the lease, bank account statements, insurance info, just a few things with the understanding that if he needed to see more, we had it with us, anything he could possibly want... The first questions he asked each of us were my own and my partner's full names and our dates of birth. It helps to keep the responses as short as possible but to add some personal details here and there.

After questioning me, he called me wife back to join us, then said that he was satisfied and approving our I-130 petition.

Hope that helps; do you have such an appointment coming up?

Len, thanks a lot for your answers. Do you or anyone else have any response to my questions regarding the I-864 affidavit of support?

Just some additional information for everyone about my situation, specifically regarding question 5 above about adjusted gross income (AGI).

I actually have a well-paying job working abroad for a US employer. I earn over $90k and they've agreed to relocate me at my discretion. I have their offer letter in writing which we signed a few months ago.

The only reason why my adjusted gross income (AGI) is low is because of the foreign earned income exclusion and housing deduction which allow me to waive over $85k in tax liability since I'm working abroad.

It shouldn't be a problem since I have a guaranteed job and source of income upon our move but I'm just concerned that entering my actual AGI of about $1000 will trigger a red flag for them, even though it's very misleading.

What do you think?

Any advice for my other questions too please?

Thanks.

Ah, okay, I understand now. You have a continuing source of income, and from a US-based source. Bring along the offer letter, and anything you have that testifies to your employment situation, like a letter from your employer stating how much you have made, that it was from a US company and that it will be a continuing source of income. Wouldn't hurt to bring along a few recent pay stubs too.

Again, the worst that can happen is that you will need a joint sponsor, but I think it is more likely that if you explain to the CO on the day what the situation is regarding your income, you will be allowed to be the sole sponsor. Good luck!

Get a new version (recently dated) of the letter from your employer. As long as you can prove that you shall be able to earn $90K you shall be ok.
