Seperated 3 months after filing for removal of conditions

Hi my wife walked out 3 months after we filed for removal of conditions, we had live together for 9 yrs prior to this. but had only been married for 3 of those 9 yrs. we have not filed for divorce,but i honestly don't think that we will get back together.guess my concern is two fold,if i file for divorce now i am sure it wont be finalize before there is ruling on my case which was filed back in July 08,second if we get called for an interview and she do not attend what are my chances of going it alone?

That's only a solution if the US spouse is willing to attend. If you are called for an interview and your spouse is not willing to attend, you should attend and inform USCIS that you recently separated and are either still separated or now in divorce proceedings. Perhaps the AO will adjuciate the joint petition, but if not, then let's hope the AO will permit you to withdraw the jointly-filed application and replace it with a waiver.

if she's not willing to help you out you'll have to withdraw your application after your divorce is done and apply with a waiver, including an affdavit from your ex-wife stating that that marriage was in good-faith,but you ought to consult a lawyer, as of matter of fact a few lawyers..some immigration lawyers are more experienced with your situation than others..
