Getting Married in US on Tourist Visa and coming back to Canada

Hi,

I am a Permanent resident in Canada and would like to get married to a US citizen. My fiancé lives in New York. I have a tourist visa. I work in Montreal and have no intention of staying in US. I would go on a weekend , get married and return back on Monday. Should I enter US on a tourist visa and get married and then return back to Canada.

Once I return back to Canada, we will apply for consular processing.

Please advice if I should go on a tourist visa to the US and get married and come back and process my consular processing.

I understand the legal requirements. We can get married in Canada. the only drawback is that it take 3 months to register the marriage and get the certificate. In US it take 2 weeks to ge the marriage certificate. Should we get married in Canada instead ?My only concern is , that I will be going to New York for only 3 or 4 days on a tourist visa. I would get married and return back to Canada. We would file our consular processing from Canada. I will be entering US only for 4 to 5 days and getting married on a tourist visa and coming back.

Will this cause problems in our application..

Any help will be greatly appreciated.

And don't tell them you're going to get married. Just tell them you're going for a visit. Because even with ties to Canada, they would be likely to deny you entry.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Hi,

Will it raise any suspicions if I went to US for 4-5 days, got married and came back to Canada. The reason we want to get married in the US is because you can get the marriage certificate in a matter of days whereas it takes over 2 months to get the certificate in Canada.

Please advise if this will raise any red flags in our processing.

Okay, I give. You've had your answer in at least three separate threads now. Why are you so concerned with it raising flags? What suspicions do you think they will have? Is there something you are attempting to hide?

I just dont want them to refuse me entering on the tourist visa. But anyways we will make a decission.

Hi Saloni,

No, it's not illegal that you come here to the US and got married while you were down here for a visit from Canada. As long as you came here WITHOUT the intention to get married in the first place on your visit and are not doing this as to avoid and/or break immigration laws, then it's fine and legal to do.

I was in a similar situation before too, as a Canadian, when I came over to visit my boyfriend (now husband), on a 2 week US tourist visa (they gave me a B-2 visa in my passport, even though I'm from visa-exempt Canada), then ended up getting married here in the USA, stayed in the USA after that, and the rest is history...And yes, I did file for the Adjustment of Status and was approved and got my US Green Card afterwards.

No, it's not illegal that you come here to the US and got married while you were down here for a visit from Canada. As long as you came here WITHOUT the intention to get married in the first place on your visit and are not doing this as to avoid and/or break immigration laws, then it's fine and legal to do.

There is no law against going to the U.S. and getting married (even if you intend to get married before you cross the border).
