Hi Niagara. My case has not been touched lately, first prima facie is expired, my lawyer did not request a new one, just waiting for final decision (they have 90 days left to do it). It's sad and exhauste to check my case status online every single day and also run to the mailbox looking for immigration letters... 15 months has been passed since I filed it and no aswer as of today.

Does anybody know how long does it take to get your I-485 approved after your I-360 has been approved???? I filed both of them at the same time and paid the fee... All this time has been a waste of money and energy for me.... I feel I can't handle it anymore.......

I don't understand WHY your attorney doesn't want request extension? I don't need even remind to mine about me. Ask your attorney to write letter to VSC.

Just be patient,EWTN2009. There are not much longer to wait. I hope you get approval soon.

In 1 week it will be 14 months. :(

My attorney was in 2007 "The best 100's attorney in the world" and she work with me for FREE.

GOD sent her to me.

:o WoW Niagara! That really is a blessing. I'm still paying monthly fees to my attorney... Oh Well, What can I say at this point? It's so frustrated just sit and wait until a freaking letter comes in my mailbox. I will keep you posted until something comes up.

My FIRST PRIMA FACIE letter expires this week. I asked to my lawyer if we're going to send a letter to renew it but he said it's not necessary. I'm getting confused because I read in some of your postings that we have to request a renewal... What should I do? My case was touched once only. I have not received any RFE and like I said before, I sent my I-360 on March 2008 (15months ago) Any suggestions?

You should. Maybe this way they will look at your case. I hope you get an approval. I think they already working on your case since it was touched.

My Prima Facie will expired on May,31. I will contact my attorney next week ask her what we should do. I hope i get something soon. :(

It seems like we both have prima facie expiring on same date (5-31-09). Even when mine expires soon, that letter states that they have 150 days to make a decision, so my lawyer says is not necessary request a new one since deadline is August 30.

If you don't mind let me know what your lawyer says.

Have you heard if someone has been approved when their cases were touched in April 2009?. :(

You need to write to USCIS and request an extension of your prima facie. You can use the primafacie to extend your driver's license. It can be a one sentence letter:

Your name

Your address

USCIS

Attn: Vawa

Vermont

RE: REQUEST FOR AN EXTENSION OF PRIMA FACIE

Dear sir/madam,

The purpose of this letter is to request an extension on my prima facie which has expired. My receipt number is EACxxxxxxxxx with an expiration date of xx-xx-xxxx.

Thank you for your help.

Sincerely,

Make sure you include a copy of your expired prima facie.

You have nothing to lose by writing to request a prima facie. If they are working on your case right now and have approved you, they will send you an approval. If they haven't gotten to you, then they will send you a prima facie BUT at least it will remind them that you are still pursuing your case.

I filed my case at the beginning of April 2008. I received a total of 3 prima facies and I had to request all of them. They don't just send them out. If you read your prima facie carefully, it tells you to write to them 15 days before it expires and request a new one. I didn't read that and I was waiting for my prima facie for about a month after it expired. I finally read it and sent a letter requesting it. The only exception is the 3rd primafacie which was only good for 60 days and it did not say that I could request another one after it expired. It simply said that my case would be adjudicated withing 150 days. But when it was about to expire, I wrote a letter requesting an extension anyway. I figured I had nothing to lose. The worst that could happen was that they would throw my letter in the trash. But it made me feel good to write it anyway. I sent the letter on May 4th 2009. I received my approval two weeks later. I am not saying that you will get an approval notice by writing this letter. My point is that you have to be proactive.

Hi Eva, did USCIS ask you for RFE? I was mostly abused verbally, mentally and emotionally, it's embarassing to admit but I need your advice. I won't go into details about the physical abuse. But I did not report any of these with the authorities because at that time I thought I could handle the situation and besides my family and relatives were close by.

What more can I send them to prove extreme cruelty? I was taken to the ER twice but because of migraines and not being physically battered. We don't have joint bank accounts because he did not want to. His car is in both of our names and that's just about the property we own together.

He was very posessive, he flew off the handle when I went to the movies with my female cousin. He was constantly reminding me that I'm breaking the law for working without authorization but he keeps asking for money. When I received a gift card from my aunt, we ended up using it to buy his clothes. But I can't get letters from the people who witness his cruelty towards me because most of them don't know of my legal situation. And besides, I don't tell my friends that I married an abusive person. I really don't know what to do. USCIS gave me until August to send them more evidence. HELP!
