Wow .... so much has happened while I have been away. Congratulations to all the new approvals and Good Luck to those next in line.

As for the marriage question this is what the lawyer and the lady who interviewed me said....

If I stay married, I can file in 3 yrs. If I get a divorce I have to wait for 5 yrs.

26th Feb, 2009 - Filed the I-360

04th Aug, 2009 - Filed another I-485, I-765

28th Aug, 2009 - Received EAD

15th Sept, 2009 - I-360 Touched

16th Sept, 2009 - I-360 Touched

23rd Sept, 2009 - I-360 Approved

23rd Sept, 2009 - I-485 Transferred to NBC

So, if i divorced befor green card i need wait for 5 years? :unsure: How it works?

And just a very quick question, on the notice it states to bring your spouse's birth certificate or evidence of US citizenship, do I need to take that? Because I don't have it or even a copy of it.

I recall asking about that a while back. The instructions state somewhere that your abuser has to be a US citizen. From my e-interpretation, the burden is ours, we the petitioners, to prove that the abuser is a US citizen.

The best option is always the GC card, birth certificate or certificate of naturalization. However, in most of our cases (like urs NJ), we can not get this evidence from the abusers. Some states allow people to get these vital docs online, but others like where my ex was born, it is not acceptable. Only him or his birth parents can ask for the BC.

Another option I found is using affidavits of people who know your ex. People who know she was born here. If they can write affidavits to that, it helps. That is what I used. My ex also had a loong rap-sheet. I do not think any immigrant can have such a rap sheet and remain in the US. He will be sent back. I just discovered the other day that my ex did 10 years for manslaughter back in the 80's.

This makes me feel really stupid.

Dear TransPorter,

I never sent any Doctor's / medical report , Police report. When you write a Declaration letter to USCIS, explain in detail about all the situations your faced with your spouse.

My VAWA got approved without the above two reports and its not mandatory to have all the report/letter. Everybody's situation is unique in its own way.

Hello Transponder,

If you file VAWA I-360 only the answer is No they won't place you in removal proceeding if your petition got denied but if you filed/applied I-360 concurrently with I-485 and your I-360 got denied Yes they will place you in removal proceeding because ICE will take over your case for removal proceeding before immigration judge, but you can apply for relief before immigration judge if you qualify for reliefs benefits. If you have a solid evidence/proofs and genuine case about the abuse, battered and extreme cruelty you suffered from your spouse/ex-spouse, yes file/apply I-360, I-485 and I-765 concurrently only if the abuser is a United States Citizen. But if you know your evidences and your proof is not solid or you haven't gathered all ur evidences in full, filed I-360 only....Sometimes there is no difference because you should have strong evidence and solid proof of the abuse, battered and extreme cruelty you went through from your spouse or your ex-spouse before thinking about filling I-360 anyways because Vermont Service Center Will scrutinized you and request for more evidences if what you give/gave is not enough. So think before you file at all. File Everything together if you sure and convinced that you have strong evidence and proofs to backup your claim. Good Luck ! :whistle:

hello all

I wonder I filed my I-765,I-485, and I dont get any mail or reciept number .. do I need to call USCIS to get the reciept number so I can check my status online or should I wait .. I didnt get any mail from them .. what should I do ? or maybe the Local USCIS got it?

You're welcome.

As Victoryismine saying, if you have enough evidence you will get the primafacie as the first level of accepting your case as a genuine one.

If you want to work and nobody there to help you financially, its better you can apply for I-765, I-485 to get the EAD to work in United States.

If you do have any other working visa you can work too.
