Dear lostinNJ,

Thanks for the answer. I have another thing in my mind that VAWA is free just like or we have to apply waiver to make it free. Is there any section which we have to mention or any column where we have to tick to making it free?

Sorry for asking too many questions, but I want to make it perfectly clear. As in AOS we have to apply waiver, that's why I am getting confused.

exactly VAWA is free.

As my source if you can not afford In AOS you can apply the fee waiver ...

can somebody help me pls.. i dont understand this...

Documentation

Documentation, such as the suggested examples listed below, may be submitted to provide proof of the "inability to pay":

* Proof of living arrangements (i.e. living with relatives, living in the individual’s own house, apartment, etc.), and evidence of whether the individual’s dependents are residing in his or her household.

* Evidence of current employment or self-employment such as recent pay statements, W-2 forms, statement(s) from the individual’s employer(s) on business stationary showing salary or wages paid, income tax returns (proof of filing of a tax return).

* Mortgage payment receipts, rent receipts, food and clothing receipts, utility bills (such as gas, electricity, telephone, water), child or elder care receipts, tuition bills, transportation expense receipts, medical expense receipts, and proof of other essential expenditures.

* Any other proof of essential expenditures.

* Proof that verifies the individual’s disability. The individual may provide proof of his or her disability by submitting documentation showing that the disability has been previously determined by the Social Security Administration (SSA), the Department of Health and Human Services (HHS), the Department of Veterans Affairs (VA), the Department of Defense (DOD), or other appropriate federal agency.

* Proof of the individual’s extraordinary expenditures or his or her dependents residing in the United States. Essential extraordinary expenses are those which do not occur on a monthly basis but which are necessary for the well being of the individual or his or her dependents.

* Proof that the individual has, within the last 6 months, qualified for and/or received a Federal “means-tested public benefit".

* Documentation to show all assets owned, possessed, or controlled by the individual or by his or her dependents.

* Documentation establishing other financial support or subsidies--such as parental support, alimony, child support, educational scholarships, and fellowships, pensions, Social Security or Veterans Benefits, etc. This includes monetary contributions for the payment of monthly expenses received from adult children, dependents, and other people who are living in the individual’s household, etc

* Documentation of debts and liabilities--what is owed on any outstanding loans, credit cards, etc. by the individual and his or her dependents, and any other expenses the individual is responsible for (i.e. insurance, medical/dental bills, etc.).

You're almost there. So you're much better position to take care of yourself than most of others who are struggling to get their VAWA approval.

Thank GOD and I understod that you too gone through all this phase. (Waiting for VAWA approval as everyone)

Once your fringerprint done, you will get the Interview for GC pretty soon. :)

Hello! I got approve of that I-360 on jun,2/ 09. I got my permit to work last month, i asked a lawyer says i am no elegible now for an adjustmen of status because my ex- husband was a resident alien, so he says i can apply for a visa, he says it is a very very complicate work a head and that i will have to wait for another 4 years, i am not sure if believe what he says, because he gave this aswer after 2 weeks, he says never have a VAWA case before. Please somebody can tell me more! I have 11 years with out see my family!

First welcome to this Forum and CONGRAGULATION on your VAWA approval. Now you're on your own, nobody can bother you.

I think you married to an Green Card Holder and hope he might filed a I-130 for your Green card. If you have the Receipt Number for the I-130 their will be a priority date and it depends upon the country you come from. If you don't have the I-130 receipt number , No worries. You can go ahead and file for I-485 along with I-131 for travel document. If you never over stayed in US then once your I-131 travel document approved you can go outside US but in general attornies saying you shouldn't but there is no rule to travel outside unless you stayed illegal (I mean you're visa expired and you stayed even one day more than the expiration date of ur visa).

There is no filing fee and no need for fee waiver for I-360 as this same form is used for Religious worker for their work.

If you planning to file for I-765, I- 485 then you need to send the fee waiver request and you have to mention all other details. Please check in some of the old pages as I mentioned about fee waiver form.

No waiver, just fill out the application and send in along with all your supporting evidence, good faith marriage, proof of abuse, police clearance from places you've lived within the last 5 years...

coz as they said you need to have other documents besides an application for a fee waiver ...

a proof of inability to pay...

Yes it was a very long grueling wait, 20 months before I was approved. The wait can be frustrating, and if you don't have a support system you can really lose it, but you guys held me up, everyone's stories gave me hope and I held onto that, and was finally approved last month. So it takes a little bit of faith and patience and it was all worth it in the end.

Yahya, I would give it about another 2 months, that's how long the majority of vawa applicants took before they heard something, atleast those who applied early 2008. It took my 15 months before I heard anything, and that's when I got my RFE.
