Dear LostinNY2007,

I can understand your situation. But I am wondering whether you applied your I 485 (AOS) and I 765 (EAD) along with your I 360. As your husband was an USC you could be able to do that. Further, if you want you can still file these two ( i.e., I 485 and I 765) based on your I 360 pending. You can talk to your lawyer regarding that. In that way you can at least get the EAD and start working.

As far as approval of I 360 is concerned it takes pretty long time to get approved as you can see the others time line in the same forum. But the good thing is that you have already completed one year and you could get the approval in some few more moths (say two or three). So take it easy and you can always file your I 485 and I 765 right now also and once your EAD gets approved you can start working.

Dear LostinNY2007,

You can also ask your lawyer to write to USCIS to get the present status of your I 360 and to make the decision ASAP describing your present situation. I have read in this same forum that some people have done that and based on that they heard something from USCIS quickly.

I hope others who read your post would be able to suggest you some more.

Thank you for your reply but I did have a file a I485 and a I765 when my husband petition for me I did have a work permit because he a usc we went as far as the interview and to prove a point he withdrawn the I130 tha's when I get the letter that put me in removal proceeding. I didn't eve know he did it we got letter from immigration and he told me to pick it up at the post office we each got a letter when i read mine that is when I find out what he did. He told me he was going to file it back but he never did. my lawyer didn't file a new I485 or a I765 he only told me that if the I360 is approve the judge can grant me the GC. I was seaching the internet and come across this form as I didn't know any thing about the I360 only my lawyer told meI wanted to know if anyone he been in my situation.

Ok. The thing is that your I 485 is denied (which is what I understood from what you wrote). Once your I 485 gets denied, you EAD also gets canceled (you can re read your denial letter to confirm, it must have been mentioned in that letter). You have to reapply your I 485 (AOS) and I 765 (EAD) again. I 360 (VAWA) is only a substitute of I 130 and therefore, only the approval of VAWA will not get you greencard. You have to file your AOS for that. The earlier ones applied are already denied and will not be reconsidered unless you file for a motion to reopen which further has a time limit (I don't know know whether you still have that time period left).

I am just giving your my ideas, but you need to confirm it from others too.

Hi everyone, I am new around here but I am glad to find a forum of this kind. Not sure if my information is of any use but here it is and for no reason should you panic because USCIS works differently and I am not able to guess the order in which the applications are processed. Though the wait it long, i think they are understaffed to do the job given the number of applications they need to process. Anyways, i filed a year ago and see that My application has been touched today. I did get prima facie twice (second one was renewal).So no idea what the touch was about, it could be approval or denial or even just looked at my application...gotto to wait and watch but will keep everyone posted.. and thanks again to whoseveer idea it was to create this forum and to enable creating such forums

Has anyone been able to travell with advance parole when the i360 is pending and return without trouble?

Do not do it. Back before I filed for VAWA, I sought consultation with an attorney (cost me $150 for 30 minutes), and she said not to leave until you got ur GC in hand.

I just checked and the touch yesterday on my app shows now that a second RFE was sent. Has anyone else got a second RFE? If yes, what was requested in the second RFE?

My second RFE was for "marriage in a good faith".
