Vermont Service Center staffs is now working overtime and extra hours to adjudicate and review cases on Saturdays and Sundays due to heavy backlogs !!! So you might noticed your case been touched and I-797, Notice Of Actions been issued on Saturdays and Sundays.... My Extension Of Prima Facie was issued on Saturday 11/07/2009 :unsure::wacko::blush:

I got the extension and within a week I got the approval. Lets hope for the BEST.

Have another question who qualifies for VAWA (I 360)? Is it for those who already have conditional green card or for others too who does not have any type of green card at all? Please share your experiences.

vawa are for poeple whos dosnt have any green card . if you have conditinal green card you dont have to file for vawa you will be able to left the condition

with out your wife/husbend . i did read alot of post in VJ poepl who left the condition

i just got an email from my attorney say .the he got 2nd prima facie i dont know for how long but the toched it wasnt approvel it was just anther prima facie

You don't need the I-360. What you need is file the I-751 (yes normally) same as if you will do it jointly but you mark on the BOX E :

" I am a conditional resident spouse who entered a marriage in good faith, and during the

marriage I was battered by or was the subject of extreme cruelty by my U.S. citizen or

permanent resident spouse or parent."

And the only person who sign that form will be you.

You filed the form with all the evidence that you have from your bona fide marriage not limited to bank accounts, joint tax returns, lease,loan, bills etc etc in both names or in name of one or the other but that STATES THE SAME ADDRESS!! Whatever you can get from your relationship. Pictures, did you have kids? if so, add the birth certificates...remember PHOTOCOPIES, no originals! you keep them that is your evidence.

Now, make a compilation of all your psychological evaluation and put a letter up front explaining why you are filing with the waiver of abuse spouse. Add your doctors, therapist and social workers, is IMPORTANT that they include their license number, organization they belonged to and their name and address. You will add that as part of your evidence to be filing with the waiver of filing jointly. The only thing that I am not sure is if you put originals from your doctor or copies of it...I think copies are fine since you need that information for you in the case you get call for an interview later on.

Since you are applying for the abuse waiver is my understanding that is the only case there is not a requirement to be divorce from your spouse.

If you need more info, there are information on shelters that can give you a legal aid counseling free of charge or with a small flat fee and that will help you to get through your immigration situation.

@ Yahya54...I know there must be something coming in the mail for you and like "Honest" said in the previous post, approval might be coming soon as well. They must have issued your Extension of Prima Facie when they issued mine. But we will soon be approved soon or later with smile of relieved on our faces.

To all the victims in this forum, approval is coming soon, keep believing and keep hoping and also be assured that your pain and your encounter is not in vain...you will be relieved of them all. We are all victimized but we will all be rewarded so that we can move on with our lives to succeed. Anybody that went through the abuse and violence is qualified to file for VAWA I-360, you do not have to be in status but the abuser must be a U.S citizen or Green Card holder to qualify you to file and the abuse must have been done to you in United States. Also must prove that the abuse take place. Above them all it might be late but soon or later you will be approved... Good luck everybody going through the pain like me and may God bless you all...Amen :):yes:

Dear yahya54,

I do not have any type of green card. I came here on a K3 visa and applied for AOS and on that basis got my EAD. I was waiting for the interview date for AOS. But my husband was always abusing and threatning me to send back me to my home country if I don't follow his orders. He became very abusive and thus I came in such a situation. Therefore, I am planning to file VAWA. I want to know in these circumstances do I qualify for VAWA? My marriage is more than two years old. If you can clear this then I would be very thankful.

'deeplyhurted' if you want to file vawa you have to prove

Eligibility Requirements for a Spouse

You are:

1- married to a U.S. citizen or permanent resident abuser or

2-your marriage to the abuser was terminated by death or a divorce (related to the abuse) within the 2 years prior to filing, or

your spouse lost or renounced citizenship or permanent resident status within the 2 years prior to filing due to an incident of domestic violence, or

you believed that you were legally married to your abusive U.S. citizen or permanent resident spouse but the marriage was not legitimate solely because of the bigamy of your abusive spouse.

3- you have to prove that marrige was enterd in good faith

4-your prson of good moreal

I don't know if anyone have been in my situation so here goes I was marry to usc in 2007 everything was good until a few months after the marriage he start to abuse me my husband withdrawn the i130 he file for me just to prove to that he have the power to make me go are stay now I am in removal proceeding I got a lawyer who file the I360. It was file december 2008 and it feels like forever I have been so stress out. I would like to know if anyone have been in my position to tell me what was their out come as my lawyer told me if I get the I360 approve the judge can grant me the GC. The waiting with no job and two kids to take care of its like hell.
