Hey Yahya54, 2nd Prima Facie doesn't matter much than the first one.. 1st prima facie confirmed that you are eligible and also that you have a case. If you don't get welfare you don't have to worry about the 2nd prima facie but people requested for it because its a routine and it might help sometimes to update your case but not guaranteed. My lawyer told me that if you are a male victim your case might be handle a little bit different to some female victim in serious distress because female need more help and assistance more than male victim. But your case will be adjudicated appropriately the same way. But female case might also be adjudicated quickly than male victim and this is due on the level of incident.

Yes I know, you are right thats why I said it depends on the level of incident. Thats why some case adjudicated earlier than other because it base on the urgency and the level of incident. Trust me they favor female victim than male victim because female face more than male in violence.

Dear Yahya and Victoryismine.

Don't worry. Things will go in favour for both of you. Take it easy.

Its the truth that female are always going through lot of Pain & Sufferings than Male and it doesn't me male are not victim under female's violence. If you see in percentage wise its always female the most suffering because of Male and also Female too.

Male victim will have to proved more to convinced them that what they went through is legitimate and truthful. But once you can prove to them with detail and vast of evidence they will approved you in no time...but male case are more often delay than other.

My case is not even up to a year and am praying to God for quick approval. I have faced a lot of trials and tribulations...I went through series of abuse and violence. But victory is going to be mine soonest. I have tons of evidence and i bombarded them in Vermont with it. And also am in removal proceedings but the judge is waiting on my I-360 to adjudicate my I-485 that my lawyer filed with him. I will succeed at last by God's grace so I can move on with my life. Trouble don't last !

@ Yahya54...Yes I have a court date coming up this December and they aware of it in Vermont. Am really confident that I will get approval soon because I have strong evidence. You know what if they want to denied you they could have done that long time ago. They never requested for any additional evidence from me because I rained them down in Vermont with loads of evidence from all angles. Good news is coming man ! Don't worry relaxed and wait for it this week or next week no doubt about it. When they touched your case in a row they really working on your case and if its a RFE it could have be a touch.

HMMM .....Am I reading this correctly????

I'm trying to understand the comments above.

1. Everyone here is either going thru this immigration process or helping others.

2. I-360 DOES NOT DISCRIMINATE FEMALE or MALE.

3. No where does it state in the I-360 preference over another in regards to severity of abuse and male/female.

4. It does mention court cases will be looked at if need be in some cases to make sure the applicant qualifies for I-360. But it not say the I-360 will be approved.

No where does USCIS say or comes close to determination of I-360 process based on severity of abuse! I find such a comment offensive, to everyone here to say one persons suffering more than another male or female. USCIS I-360 cases also are not adjudicated based level of incident of abuse. Remember you are applying for right to become an American Citizen where ALL are to be equal maybe the place to start is to get in line "next too" others who "share" this process.

Most here seem to pull those along and carry each other from time to time. I take a look at the road ahead not behind in helping others here for what ever the reason maybe. I hope others don't think ones case is "more important or serious" than others.

I hope I read those comments wrong.

I-360 Time Line

May 2008 - 1st attorney filed I-360

August 2008 - 2nd attorney re-filed I-360 after no response of file from first

2008 PFD - 2 received extensions

2009 PFD - 3 extensions

November 2009 - RFE received and sent back first week.

November 2009 - 2nd week USCIS letter stating 60 days to make decision.

January - 2010 - received 60 day extension

February - 2010- APPROVED I-360
