I am really happy for your approval notice! I am sure you were waiting for this everyday.

My question is that can you please tell me the steps that you took?

Did you file i-360-i-485 and i-765 together? Were you married to a US citizen?

Dear Musafir,

Thank you for your wish for my approval.

I filed only I-360 as I married to an Permanent Resident (Green Card holder).

If you married to an US citizen then you can file I-360, I-485 and I-765 together to Vermant service center and use © (9) option on the I-765 form.

For more info on filing just see the previous pages where I sent out a link for sample letter and list of documents to send to Vermont Service Center.

I have a quick question. I just sent in more evidence today.

However, I do not know how to go about finding my ex-husband's divorce decree from the first marriage. I do not even live in those states anymore.

My ex was a master liar. He operated in 3 states. Where he was born in MI and where his mother was born OH/KY.

I have sent requests but they keep asking for the date of that marriage and divorce. All along I ahd thought it was 1992, so I gave 92, nothing showed up. I effectively do not know when they were married, neither do I know the person.

Using the internet, these states only have certain data (1992-current). MI wants a 5 year time period.

What d'u guys suggest?

11/06/2009-Changed Address online

Hope someone can answer this one (especially those who have gone for the interview after VAWA approval).

I need to change lawyers coz mine is just too expensive to take with me to the interview. Is this advisable? Has anyone done it? Please, please let me know.

Why they need your husband's first marriage divorce decree? Its impossible to get from him.

You can try to the court in the state where he lived in. sometime the divorce decree will be available for the public. It depends upon the state and also the court.

try to contact the court in your state where you live in right now. They might give you some idea on how to get ex's divorce decree. Just a try.

try to contact the court in your state where you live in right now. They might give you some idea on how to get ex's divorce decree. Just a try.

I agree. From my research, NOTHING pertaining to your ex-husband is relevant on an I-360 case except the abuse information and Date of birth. They will see everything else by background search. His background before you is not relevant unless he was married to someone else at the time or he married you in to stay in the country. But since he is a USC nothing more than his basic info is needed.

I-360 Time Line

May 2008 - 1st attorney filed I-360

August 2008 - 2nd attorney re-filed I-360 after no response of file from first

2008 PFD - 2 received extensions

2009 PFD - 3 extensions

November 2009 - RFE received and sent back first week.

November 2009 - 2nd week USCIS letter stating 60 days to make decision.

January - 2010 - received 60 day extension

February - 2010- APPROVED I-360

You are forgetting an important thing, all of you. In order to be eligible to self-petition, the person must establish a QUALIFYING RELATIONSHIP with either USC or LPR. To do this, you have to submnit a marriage certificate. On the marriage certificate each party has to disclose whether they were married before. Apparently, MulanJohns' husband part of marriage license says that he has been married beofre and got divorced. USCIS has every right to request proof of his divorce, otherwise they don't know if there is a qualifying relationship or not.

My counselor said, if you're in dange with your husband and you're not in a position to save yourself and how come you can able to get his previous marriage certificate. If you have the marriage certificate between you and you're husband its ok and you can write a letter explaining the situation and its not possible for you to get the information.

Anyhow I don't know how much they are trained on this VAWA. As a person who gone through all these nonsense knows much better than anybody.

The problem with the counselor's advice is that s/he is trying to tell you that you don't have to stress about the missing evidence of a legal divorce. But for USCIS it is important to know if an abusive spouse terminated previous marriage legally or not - you can't say that because you were abused you cannot get a necessary document because all marriage and divorce records are PUBLIC. It means that you can actively search for those and retrieve them, without the help of your abusive spouse. USCIS position is that whoever applies for an immigration benefit has to prove that they are eligible, it's not like USCIS is going to look for missing evidence for you. If they don't get what they want to see, they will deny you!

No Need for medical report while filing as it will expire in a year.

My suggestion, If you have one in handy please submit along with you I-485. you can call USCIS customer service for more info.

I would like to comment regarding confusion with the medical report and I-485. The general guideline is that the report is valid for a year.

However, it is incorrect to state that one should not include a medical report with initial I-485 filing since it will expire before I-485 gets adjudicated. I don't know where this information comes from.

What I'm about to say was given to me by an immigration officer. So, when I brought an updated medical report with me to the local office that had my I-485 file, the officer said it was not necessary for me to do that, BECAUSE the medical report initially submitted with AOS application will NOT expire in a year, it will be acceptable even if your AOS takes more than a year to adjusicate. If your AOS gets denied and you decide to re-file, then you wil have to obtain a new medical.
