First of all, they never have requested me any RFE. I sent 3 letters requesting extension of prima facie because my lawyer NEVER asked them for and I found out throught this site that we gotta request those extensions. And my lawyer has sent 1 letter requesting adjudication of my case due to my 3rd hearing... but still no answer....... So, 4 weeks left and I'm out off game!

Ps. I usually request you to pray for my approval, but at this time I beg you to pray for my brother and mother's recovering. They're both at the hospital where I'm originally come from PLEASE :(

EWTN2009, how many letters did you send to VSC in total? I sent just one on June 3 2009, and they resumed working on my case 6 days later.

Hi Mona_lisa: (F)

The interview letter tells you everything you need to take to the interview, I took everything I sent for the VAWA, and all I sent with the I-485. Remember that the VAWA petition is approved already, so no panic!! (easy to say, I was panic!!!) The interview is quick and they just ask some questions about the I-485 form and G-325A form

All I took to my interview:

Passports (3) Mine and my 2 kids

My old Employment Authorization Card

I-864W Intending Immigrant's Affidavit of Support Exemption THROUGH VAWA

MEDICAL EXAM'S (the doctor gave me copies, just in case)

Marriage certificate / Divorce judgement (and translation's)

Birth certificates (and translation's)

Chronology of entries and exits THE OFFICER ASKED ME THE LAST ENTRY TO THE USA

ALL NOA'S and everything I received from USCIS

OTHER THINGS:

Passport and k-3 visa for me (old ones)

Passport and k-4 visas for my kids (my exhusband cancell the process for myself and our 2 kids)

Copy of Naturalization certificate for husband at that time (exhusband now, he filed for the divorce when the restraining order was placed)

All restraining orders against my ex -Final after trial good for 3 years

Certified court order after trial w certificate of compliance w/VAWA

I-130 applications approved for myself and my 2 kids (and cancell later on for my ex)

Pictures injuries in my arm and declaration of picture taken (My boss took me to a domestic violence place, they took pictures of my arm )

Pictures of my oldest son injuries, his dad bit him

Statement of my boss who saw the injuries

During the interview everything went well, the officer was extremely nice, he went through my file, asked me some questions, if my address is still good and my phone number is current, I said yes, he asked when was the last time I came here and checked the previous visas k3 for me and k4 for my sons (made copies), also asked me some of the NO questions of the I-485 and I responded no, no, no to all of them, he asked if I was working and I said yes and hand to him a letter from my work, he ask me if he could keep the letter and I said yes,

He tried to make conversation to my sons and laughing at the same time, he asked how’s school and if they get in trouble, of course they answered nooo, he asked me for how long I was married and I answer that for 14 years, and how many times I have been married and I said.. just 1, then he turned around facing my kids, and told them that everything is over, that they now have a new start and they need to take care of their mom, I was almost in tears, I couldn’t believed that an officer can be a human being like us.

By the end he explain to me that after 2 years and 9 months from today I can apply to the citizenship with the form 1-400 and I can file the form I-600 (together with mine) for my youngest kid and he can get his citizenship through me without any text ( under 18 years ), my other son he needs to do the same than me because he is gonna be over 18, but that it will be fun to do it together, he said.

Then he gave me three letters one for each one of us saying the approval date (august 18, 09) class lf adjustment IB-6 for me and IB-8 for my kids and that the permanent resident card will be mailed to my address within 21 days

Mona_Lisa Best wishes for all of you! all is going to be just fine!!

Gabriela

Hi you guys,

I just received an appointment for my adjustment of status interview, DEC 7TH. Question for all who have been through this, especially Ghanamade and Gabriela. They have asked to me take a lot of documentation, like my application is based on marriage. Things like I already submitted for the I360. I don't have any more bills to take. What did you guys take with you? Did you need to take your spouses birth certificate and the like?

Hi Gabriela. You're the best. I guess i will take copies of all that I have. Thank you so much for all your help during this process. God bless you.

Hi EWTN2009

thank you for your response about court proceedings. Everything is going to be fine for everybody.

Thanks Honest... There is no answers to my letters from Vermont office, no answer to my Lawyer's Letter sent the first week of october, no touches on my case, no decision has been taken, N O T H I N G .... It seems like nobody is working on my case or just dissapear from their office. I'm getting ready for my proceedings court and packing up. My deadline is December 3rd. 2009..........

Hi Honest, the appointment is for biometrics. Thank you so much though, at least I already have a "best wishes" for my interview whenever it may be. And to everyone here, I wish you good luck and thank you.

Dear bubbles14la,

Something is happening on your case, I am happy about it. thank for the update. I really taught that the interview is for your GC.

I wish all of you, LostinNJ and Konja to get the GC without interview if possible or to get an interview for your GC.

Dear EWTN: I wish, you should get some update on your case this week.

EWTN:

I would suspect that your case is not being adjudicated because your A-file is at the local office which has responsibility for your deportation proceedings. USCIS will only adjudicate a case once they receive the full and complete file - they call it the A-file. It is my understanding that the VSC should request the A-file but it appears (sometimes) that they are not aware that they need to request this from the District office handling your deportation case. What this means is that your attorney is most likely asking for continuances on your court proceeding waiting for your case to be adjudicated while USCIS waits for the Immigration Judge to rule on the case - your case is in an endless loop.

NOTE: There are MANY reasons why your case could be delayed, however this may be ONE reason that you may want to rule out.

I would suggest the following:

1) Have either you or your attorney contact the District Office handling your deportation case and ask for the "attorney on duty" that is handling your case and confirm that your A-file is in fact in the District Office.

2) If the local District office does indeed have your file, have your attorney contact USCIS using the special number advocate number [802-821-9752], and ask them to request the A-file from your district office.

3) You can ask the district office which is handling your proceedings for information on when a request from VSC was submitted and when the file was received by VSC. This takes about 2 weeks after the request is submitted.

4) If you or your attorney do not get any results after utilizing USCIS advocate line- try you local Congressional Representative.

Guys, do you think i will have another interview for my I-485 or they can waive it, since i already had it in 2006?

Dear Niagara,

Generally they have the interview because I asked about you to my counselor and she said after the VAWA approval they will send you a interview notice.

I am not sure but what I heard, I am just sharing with you.

Hi HONEST;

I am really happy for your approval notice! I am sure you were waiting for this everyday.

My question is that can you please tell me the steps that you took?

Did you file i-360-i-485 and i-765 together? Were you married to a US citizen?

Please advise, thank you,

That is some great advice. EWTN now you have something to go on. I always wondered why your case was taking so long. Isn't it a shame that are fleeced by lawyers that cannot offer the advice that we get from this forum?

Musafir, I didn't file for I485 concurrently with I360, I waited until I360 was approved then filed. But others in this forum have done so successfully. Thanks for the congrats, Im so stoked too. I cant wait to put all this behind me.

Congratulations to everyone who is receiving approvals and interview dates. This is our year! EWTN, follow the advice and soon we will be celebrating your approval!
