I think this may be the reason you have no visa number available. As they are processing petitions for LPR spouses from Jan 06 at USCIS and the visa number they are working on cases from Jun of 05. I wish I had more info for you. I will try and look around to see what I find as far as VAWA for an LPR spouse.

Finally, I got my approval notice letter to my PO BOX. I got two letter one for DEFERRED ACTION and another for approval. In the approval they mentioned as shown below. Can anyone advise me on the below statement from USCIS.

The above petition has been approved.

The petition indicates that you, the self-petitioner, are in the united states and will apply for adjustment of status. The information submitted with the petition shows you are not eligible to file an adjustment of status applicatoin at this time.

Additional information about eligibility for adjustment of status may be obtained from the local USCIS office serving the area where you live.

Until you file an adjustment application, or apply for an immigrant visa, this approved petition will be stored in this office. If you become eligible to adjust status based on this petition, you shouls submit a copy of this notice with Form I-485, Application to Register Permanent Resident or Adjust Status, to the local office.

Did anyone get letter like this. Plz let me know.

I think being married to the LPR is why you go this notice as such

My counselor also said the same. She said for my country (INDIA) they are giving the visa number for Dec 1999 and she also said she is not sure.

Where do you get the information that they issue visa number for Jun 05 application. For my I-130, I see in the processing time web page, it is JAN 06.

Anyhow something is better than Nothing. If I get atleast the EAD I can work and keep renewing the EAD.

I can wait for PR. Anyhow I think there is no big difference between EAD and PR. The only diffference I see is

EAD: renew every year or 2 years once.

PR: Five years once.

Let me know what are the documents we have to attach for the PR (I-485). I am try to get the $1010 for applying I-485 otherwise I will get EAD first get a job save some money and then apply. I am also thinking of the option Fee Wavier but its not available for I-485 only for EAD (I-765).

Thank you for your wishes. So I have to wait another 2 years & 8 months as my I-130 was filed in Nov 2007 and got receipt number on Feb 2008.

I thinking of applying the I-485 sometime this year. Is it a good idea to apply now. Any comment from others will also be appreciated.

You guys are BEST OF BEST, always I get some useful information. Thank you so much.

as far as I know, State Department announces the number of visa availability (Quota) each year. Year starts in beginning of September of each year and ends in the end of August following year. So it's all depend how many visa number will be announced each year and how many people are front of you (prior receipt number). So it's really hard to tell if you can apply for AOS I-485 after 2 years 6 months. I know sounds like suck huh!

Today USCIS launched their new website instead of Tomorrow as they mentioned in the website

I been to USCIS local office today and asked them about filing I-485. The lady said I am not eligible for

1) I-131 Travel Document.

2) I-485 she said they are processing 15th April 2005 and I have to wait in USA and not to travel.

I think both the statement are false. I am not sure but I think I can apply for I-131 & they are processing 15 Jun 2005 cases. She looked in the wrong tabular column which is for getting PR through employment for Asian Indian.

You both are correct and you guys can be an attorney. Thanks a lot for your information.

My question is do they send me an letter whenever the Visa number is available?

I asked the lady in the USCIS local office and she said you can check online and call the customer service for more info or come to our office after 2 years.

After I been to USCIS local office, I called the USCIS customer service and they said the system is down and ask me to call after 4 or 5 hours later. I think they are publish the new website, when I called them over the phone.

I don't know when they touched my case until EWTN mentioned in one of the previous post about touched the file , I don't know about catholic church and also about public benefit too. No, I cannot check my status online still. I called the uscis again and they said that I should wait for a month before they can update my status online.

Dear Honest, I mean you can file I-485 petition now but they will not process it right away they will send you NOA, Receipt Number on it and when you check that number in USCIS web site it'll appear "Case Received and Pending" until a visa number available for your Receipt Date. If I was in your shoes I would go ahead and file it because you never know what to expect from USCIS they might process it shorter than you expect it, worst case scenario it'll be pending until a visa number available for you, but at least 2 years later filing fee increase will not effect you, now $1010 we don't know how much it'll be two years later:))

No they will not send you a letter or anything else when the visa number is available. You can follow it from State Department Visa Bulletin Page when you see -U- instead of date means Visa number finished and unavailable for that year and new cycle will start as I said September 1 of each year.

i file late octouber 2008 and My status is: Request for Evidence

i dont know why but they did got my evidence 2 weeks after they ask for and they never updat my status

i thoght the new web sit for USCIS will give us mor info about our cases

everything that happening at this moment is a RESULT of the CHOICE you ve made in the past...
