'EWTN2009 what the happend to your case you fille back in march so its been 16 mounth . did you got prima facie ride away or later how many prima facie you got so far . did do any thing bc/z your case out side process time

My case is out of processing time.

I only received ONE PRIMA FACIE LETTER, on April 2009, that was the first and only time that they have touched my case since I filed it sixteen months ago. My prima facie letter says that they will made a decision within the next 150 days (Deadline---- >September 30/2009) and also says that prima facie letter was valid for 60 days (it expired on May). My lawyer said that we need to wait until september 30 for getting an answer, if not he will request status of my case by then. :wacko: In my case, they haven't requested any adittional RFE and my prima facie letter doesn't say anything about request an extension 15 days before expires, then I haven't done anything......Just waiting for an answer......Otherwise, we'll file a resquest of case status. :(

i just cant understand how VSC work WHAY THEY TAKE SUCH LONG TIME

Hi all,

I came across this website a few days ago and I cannot tell you how helpful you all have been. Its nice to know that I am not alone in this long and treacherous I360 road. I have a question and any response will be appreciated. My file was touched 3 days in a row last week. Anyone with any ideas what this might mean?

Did they give you a letter stating that they will give you an answer in sixty day on your final decision after they recieved the RFE?

Yes they did. They said 'from the date this office receives your submission, it will take a minimum of 14 days to process your form. If you haven't heard from USCIS within 60 days, you may contact the USCIS..'

Btw, since the last touch on the 17th there hasnt been anything else done. So frustrasting. I thought id have heard from them by now.

Another question, is there any way to apply for an EAD while my case is still pending? Thanks guys for all your help

Mona_Lisa: :yes: I think you should try to file your EAD. I filed I-360 (VAWA), I-485 (AOS=Adjustment of Status) and I-765 (EAD= Employment authorization document) together at the same time in Vermont center , back in March 2008 and paid $1,010. As of today, my case is still pending but I received my first EAC on July 2008 ( valid for 1 year) and my lawyer sent request of renewal I-765 form last month (June 2009) and got the card on my mailbox on July 2009 ( valid for 2 years). It did work out...

HI EWTN2009. Thanks for coming back at me. A few questions..my attorney already charged me for the I360 and now he says he will charge me another $2000 for filing the adjustment of status and EAD. This is money i dont have..can i file it by myself? And where would i send it to, the Vermont center too? And when I filed the I360, my fee was waivered..is there any way to apply for a waiver for the I485 too?

I was in the same situation; i filed for green card by myself and i got advice from lawyers and they told me not to file for fee waiver beacuse it would take tooo long. and my advice would be to wait until your vawa is approved before you file for green card.... just have all of your forms filled out ready to go and when the approval for vawa comes make copies and maill it to chicago, not vermont!!!! good luck

Hi Mona, my case is still pending, but I applied for I-765 [EAD] and I-485 [AOS] in April, they sent my EA card in the beginning of June. And, if I am not mistaken, you can send these applications when you file for your I-360.

With regards to RFE, they also stated in their letter that upon receipt of the additional evidence, it will take them at least 14 days. My deadline is Aug 20, I already mailed all the papers that I can gather to my lawyer. She said, she will send them to USCIS by Aug 13.

Please let us know as soon as you get an answer/approval, so at least I'd know how long I have to wait. You're right, the frustrating part is the waiting.

Hi MONA_LISA ----- > I think your lawyer is ripping you off :angry: ... You shouldn't pay him that money just for filing I-485 / I765 :no: . First of all, I wanted to let you know that FOR I-360 (VAWA FORM) FEE IS ALWAYS WAIVERED, it says it on immigration website, so nobody should be paid for filing I-360 for VAWA. Please remember that I-360 is not used for vawa only, so the other cases must pay the fee but vawa.

Now, talking about your I-765, I'm sure that you could file it (if you're interested) at Vermont Center at anytime while your case is pending. If you go back some pages in this forum , there are people that got approved VAWA and they know a lot about filling out docs by themselves (i.e. Gabriela525, she's very nice and willing to help withthis kind of info). It's up to you if you want to wait until your case is approved and file it later. Once you decide to file I-485 you need to pay $1,010 to USCIS BUT I ALSO HAVE READ in this forum that some people asked for that waiver as well and did not pay the fee. I didn't know until few months ago when I found this website. So, take advantage of it and step forward... :star:
