I also thought I-864W was a waver but they still asked me to bring the proof of income for a year. well, i didnt work much but friends and family helped a lot so i just brought all the bank statements showing all the deposits i did. they just need a proof that you will not go to ask for the help from government straight after you get the green card.

good luck and little advice for you, bring those money proof with you, in case they ask for it, otherwise you might get a RFE and then wait and wait again, just like i did.

[/quo

Just a clarification, do we need to bring the completed I-864 when we go to the interview like this? Or shall I just bring all the proof of income for the past year? I have an interview on the 3rd and I am confused. I don't have attorney to ask with..Pls help me...Thanks...

You have to bring the proof of income and a completed I-864W -Intending Immigrant's Affidavit of Support Exemption

YOU have to fill the same I-864W for your child as well. that is all. Do not Panic:) If you dont bring something for the interview they will just give you the RFE so everything is going to be ok:)))))

Your husband can't do anything to your VAWA case. It would be a good idea to get a restraining order. Go to the magistrate and request it , don't wait too long.

But I was told by my attorney even if he starts the divorce now It can not damage my VAWA petition. But we have been married for 7 years before I took the decision to leave him . If he tries to send paperwork to VAWA against you the officer will shred it, that's what i heard. And this would prove that he keeps harassing you.

Thanks Anxious, I did called the DV unit... I think that is the way he found to terrorize me... I'm pretty sure that he knows I applied for vawa, but I'm not gonna worry about it. Is in the hands of God and He knows whats best... Thanks for your help...

You should report that he violated the restraining order. Otherwise he will see that he can do whatever he wants without consequences. Also you want to be serious about the restraining order.

I don't think he can hurt your case. What I was reading the abuser spouse and his family automatically considered not credible for USCIS. I agree, he possible meant to withdraw the affidavit. It doesn't matter, one of the purpose of vawa that you don't have to rely on him.

Dear Fehervirag,

Thank you for your answer. I was worried about my case because I did not have witnesses. I was completely isolated. But I did have a protective order against him. A passerby called the police for me ... of course there was no way I could contact an stranger but it sure helped my VAWA petition.

NATASHKA,

I took the time to read this blog from page 1 to right now :) and what I noticed is that most members got their interview 1 month after VAWA was approved . Call infopass and find out why is it taking so long.

Thanks! I completed it already but when I read the USCIS site, it says that sometimes we have to pay for a state whatever.....but there's also a note that "Don't do anything until the USCIS ask you to..." well I am just preparing everything so when they ask I have it...it's only that even when you think you are prepared, since we are not lawyers, we don't know what else will we need...Thanks for this site...I have somebody out there to answer my questions....An unknown friend....Hoping for the best for everyone...

According to my lawyer we just sent out the application in a lucky time. He said there were a couple of applications approved quickly that was sent around the time when I sent it while earlier application were still waiting. I am definitely not complaining.

My case was mostly based on emotional and economical abuse which of course is a pain to prove. However, I ended up with around 100 pages package. Besides my statement, I had verification of service letter from two different domestic violence services (from different states), letter from my psychologist. Letters from friends, one of my professors, one of my support group members. I had the statement and the transcript of the hearing for a protection order which was denied. However, the judge stated that the denial based on that the domestic violence did not raise to the level of the state statues. So my lawyer attached the statue to show that only physical harm constitute DV in my state. (Just a side note, he said stuff like I will say he hit me and I am making up the abuse claims for the greencard. Evidently, it did not hurt my case.) I had a letter from a police officer I called once when I was really upset about being put down. A few emails that was related to the situation.

Every situation is different and you have to be sometimes creative to get evidence to show what was going on. I was very honest in my statement and everything matched what I said.

thank you so much for your answer .

hi anxiousVA,

Thanks for replying, my lawyer's office called me today and they told me that called to USCIS and the uscis rep made the note on my case file and I'll be receiving something in mail(i hope it's interview notice) if we wouldn't hear from them in 60 days we have to call again. I'm very nervous why it's taking so long???

Your welcome. Any news on your side? I am here just waiting for my biometrics appointment. Did the attorney tell when you would be receiving your EAD?

Hi anxious,

I already have my employment (from my I485/I130), is been 2 months since I applied for Vawa.. I guess is a little early to expect any news... I hope I get a little touch soon though!!! It seems that people that got touches on a monthly basis got approved fairly fast... I don't want my case to be lost in some emigration limbo.... However, I don't have much to complain, I'm slowly recuperating from all the craziness that was my life a few months ago. guess I just have to pray and wait...
