Hello I am new to this website but I have found it very helpful. I just received my Prima Facie valid for 180 days but along with this notice I received a Biometric appointment for my I-485. Is it a good sign to have a biometric appointment in such a short time? Please anyone who has had the same experience .

DEC 30/2010 receipts for all applications.

Hi anxiousVA, you have nothing to worry about at this point. I think its normal, if you look back on the timeline of some of the members on here. You have the prima facie-so thats good. After the biometric is done, you wait and pray thats all.

Thank you for your answer. I was worried because I did not get RFE. Prima Facie is a good sign?

Hi Anxious, yes, prima facie means you have fulfilled the basic requirements of your petition, meaning that you can continue with your case. (something like that...). Good luck to you!! I applied a month before you, so hopefully we'll have some good news soon!!

11/21 officer called lawyer about the I485 (btw: really nice IO)

12/10 apply for VAWA, without background check

12/11 lawyer drop off a copy of I360 for the IO

12/15 Prima faice received

12/18 sent background check, also sent a letter to IO asking to expedite the I485 to vermont to be linked with I360

12/31 I360 touched

08/04 Apply for EAD renew

08/18 receive NOA

08/26 new card ordered

08/31 new card ordered (again??)

09/01 notice of approval of I765... (where is my VAWA approval??? God help me...)

I received the prima facie about a week after they received my petition. And I will be asking for a renewal. I'm just a little anxious now.

Well, their timeline says 5 months.. oh well, hope you have some news soon!!! there were a lot of approvals lately within the forum members, all around 6 to 7 months... lets try to keep it positive... :star: :star: :star:

PLEASE HELP ME WITH ANSWERS ON ADJUSTMENT OF STATUS, APPROVED I360 VAWA AND INTERVIEW?

I just received an approved i360 vawa petition from VSC dated January 26, 2011. The petition was approved on December 20, 2010 and I have a pending I485, filed on January 2010 and I asked the local office during my interview to hold on to it till my VAWA I360 is approved. Now, my VAWA I360 has been approved, I would immensely appreciate your kind help if someone can help me with the following questions.

1. How long does it take for an approved VAWA I360 to get notified to National Benefit Center to link my pending I485 to m approved I360?

2. Has anyone ever experienced this situation and how long did it take before securing interview notice?

3. Do I need to contact the local office since I suspect my pending I485 should be at the NBC or do you think its been transferred to local office.

4. My work permit EAD is expiring on March 9th this year and I would like to renew it since I still have a pending I485 since April last year and approved I360 this year. Do you think I have to renew my EAD since I'm hoping to secure my green card soon rather than paying another $380 this week for my work permit renewal?

I have read couple of things online but I would really appreciate if someone can help me out. Many thanks as look forward to hearing from you guys.

My ex just contacted me saying that he got an emigration lawyer... Can he do anything against me? I already took him out of my case when I went to the interview and my vawa is already applied... He did tell me that he filed a petition to withdrawn from marriage, I have no idea what that means. My lawyer told me not to worry about, still I'm concerned. Can he hurt my petition in anyway? I'm thinking if I should call the judge, I have a restraining order against him, so he is not supposed to contact me... Any ideas?

Your husband can't do anything to your VAWA case. It would be a good idea to get a restraining order. Go to the magistrate and request it , don't wait too long.

But I was told by my attorney even if he starts the divorce now It can not damage my VAWA petition. But we have been married for 7 years before I took the decision to leave him . If he tries to send paperwork to VAWA against you the officer will shred it, that's what i heard. And this would prove that he keeps harassing you.

A petition to withdrawn from marriage? Maybe he meant a marriage annulment. I think he tried to say that he was going to withdrawn his sponsor petition.

What I read from other members in this forum is that once your VAWA is approved Vermont Office sends your I485 with copy of the approval notice to your local Office, once is there it takes about 4 months to received your green card. Congratulations. The worse is over :)

My I-485 was touched today, I called USCIS to find out how long it takes to get biometrics appointment. She told me my file is currently at my local office, it was transferred on Monday and I should receive the biometrics appointment within the coming weeks. I also asked her if it was standard for I-485 to be transferred from NBC to local office, she said it is, I for some reason thought NBC usually sends out the bio appointment and interview notice. You should report that he violated the restraining order. Otherwise he will see that he can do whatever he wants without consequences. Also you want to be serious about the restraining order.

I don't think he can hurt your case. What I was reading the abuser spouse and his family automatically considered not credible for USCIS. I agree, he possible meant to withdraw the affidavit. It doesn't matter, one of the purpose of vawa that you don't have to rely on him.

According to my lawyer we just sent out the application in a lucky time. He said there were a couple of applications approved quickly that was sent around the time when I sent it while earlier application were still waiting. I am definitely not complaining.

My case was mostly based on emotional and economical abuse which of course is a pain to prove. However, I ended up with around 100 pages package. Besides my statement, I had verification of service letter from two different domestic violence services (from different states), letter from my psychologist. Letters from friends, one of my professors, one of my support group members. I had the statement and the transcript of the hearing for a protection order which was denied. However, the judge stated that the denial based on that the domestic violence did not raise to the level of the state statues. So my lawyer attached the statue to show that only physical harm constitute DV in my state. (Just a side note, he said stuff like I will say he hit me and I am making up the abuse claims for the greencard. Evidently, it did not hurt my case.) I had a letter from a police officer I called once when I was really upset about being put down. A few emails that was related to the situation.

Every situation is different and you have to be sometimes creative to get evidence to show what was going on. I was very honest in my statement and everything matched what I said.
