Hello every one :)

well question i filed my Vawa petition concurrently with I-765 and I-485 on October 16 2010 .. I received prima facie and my employment card. But I have not receive any notice of my I-360. should i be worried ? i do not have an asttorney so any help is appreciated. Thanx :)

Hi Dianita,

I dont know much about it, but for what I have read in older posts they usually don't approve EAD without the I 360 being approved. Good for you that they approved yours so fast... Now, the I360 takes around 5 months (hoping for less!! :))) Hope the other members can help you out!! good luck!!

12/31 I360 touched

08/04 Apply for EAD renew

08/18 receive NOA

08/26 new card ordered

09/01 notice of approval of I765... (where is my VAWA approval??? God help me...)

the prima facie is notice of your I-360 and its look like every thing is in order and you address all requirement for vawa case for now. other wise they will send RFE befor issuing the prima facie and since your I-765 is already approved that fast your case should go smoooth

you have to file i-765 concurrently with I-485 to get EAD approved IF YOU dont file i-485 than you have to wiat for vawa to be approve in order to get EAD approve

... Now, the I360 takes around 5 months (hoping for less!! :))) Hope the other members can help you out!! good luck!!

yes VSC will process vawa cases in 5 month but desont mean that they get decision in 5 month every case has it unique sutiton

work permit approval only required Filing of I 485. It is not necessarily be approval of WAVA first and then work permit.. I received Work permit four months ago and later ( after 4 months) My WAVA was approved. Just to let you guys know.

My one work permint was denied because they cannot locate my I 485. then I ask Ij to stamp my I 485 and I send copies to USCIS MO center and then only I received my work permit.

May 26th, 2009 : WAVA filed.

June 1st, 2009 : RFE issued Good moral: replied june 15th 2009

July,17 2009 : Prima facie approvel received.renewed again march 3, 2010

February 2, 2010 :I-765 filed, : denied

August 12,2010 :RFE issued on WAVA, more evidence needed.

sept 3rd 2010 : I-765 filed again. 9/15/2010:Filing receipt received.

Sept 15,2010 : REF answered with all evidences.9/17/2010:RFE recvd by USCIS.

Sept 19, 2010 : I 765 approved.

Sept 19,2010 : I360 touched. status changed to RFE Under review.

sept 20th 2010 : I 765 card production ordered, No Biometric, no picture etc.

sept 21 2010 : I 765 touched, still card in production.

No Now news on my case. In April It will be a year since I filed... Still waiting.. That 5 months processing that USCIS says about VAWA timeframe is misleading bullshit.. excuse my language.. It is just a way for us to suffer more, because not only were our husbands abusive, but not the system is even more abusive.. killing u slowly.. God give us all strength...

i heard from other poeple judge might approved me the same day and get my greencard or he might denied it and order me for deportation .please if someone went fron front of the judge and have some experiance about what will happend at the master hearing and is that true that might judge order me for deportation i am so scared i thought the big deal is to have I 360 to be approved please anyone have some idea or know what will happend let me know Thank you

First of all Gongras.on ur i-360 approval.Second of all once ur vawa is approved u shouldn't worry about being deported , u are safe now. I think ur next move is to tell the judge about ur approval and he is just going to cancel ur removal and/or forward ur case to ur USCIS local office and they take it from there. Do you have a lawyer? if you do,s/he should b able to assist you n answer ur questions properly.Can you give us some infos about the process of ur vawa?meaning how long he took for ur vawa to b approved etc... anyway Good luck.

Thank you so much i field my case last year it took me 10 month to get approved .i dont have lawyer i file evrything myself because i cant afford one .

anyone know what kind of question that judge will ask me ?

I went in front of judge many times. I handled my case by myself. My WAVA was approved in oct2010. in master hearing you should inform judge that you have your wava approved. He will ask Govt attorny to ask for your A file. and give you another date. ONce your A file will come to court , Judge will look at the paperwork you filed ( paperwork means , your I 485, etc.) once all the paperwork intact, IJ will have two choices, one he can give you individual hearing and adjust you in court( depends upon his calander0 second he will terminate your proceedings and remand your case to Immigration. If he terminate proceedings you will be adjusted with immigration officer who will look at your paperwork on interview with you.

If judge adjust you in court then , judge and govt attorney will look at your paperwork and approve you..

One thing is sure that you will not get your green card on master hearing as you mentioned above. it has to be individual hearing.

Keep in mind judge can give you many master hearings but individual hearing is one only in most cases. I also point out one more thing, Judge has to look your A file first before he make his decision because then only he will remand the case back to Immigration, For example, lets say you don't have I 485 in file and judge terminate your case, then your case will be back to immigration but you will not get interview as there is no I 485 in file.your file will just sit there with no action because you don't have further action taken by USCIS as it waited for I 485 in file then only USCIS can take action and initiate interview. thats the reason judge will make sure that you have proper forms filed before he render his decision.

You should not be worry about removal anymore, unless you have criminal history.

May 26th, 2009 : WAVA filed.
