Hi all, will USCIS listen to an abusive USC's false accusations of marriage fraud? I think this is my spouse's last straw to retaliate me.

My spouse is convicted because of strong evidences (police, injuries, eye witnesses, etc.). I have a final retraining order. I tried to be safe and leave her alone but the spouse had made up many lies and was determined to compromise me in front of USCIS. I felt very bad and betrayed. I knew they were all lies with no supporting evidence.

Thanks for the advice.

November 1 2008 filed.

November 21 2008 NOA1

November 25 2008 RFE #1 received [good faith + good moral character].

January 7 2009 RFE #1 sent back.

June 9 2009 received a letter "Response to RFE #1 received on JANUARY 13, and case processing has resumed"

August 17 2009 RFE #2 [good faith].

October 27 2009 RFE #2 sent out.

HI,

Uscis Will not listen to your spouse false accusations.. they are trained in cases like yours and know that part of spousal abuse are these false accusations she makes on you. VAWA is very confidential and will only be handled in Vermont. Basically, your I-360 replaces the I-130 she petitioned for you, even if she withdrawed it.. This is the worse that can happen.. She could withdraw her petition and u may be placed in removal proceedings if she does that. This is why it is very important to file VAWA as soon as possible so you can have the pending I-360 just in case you have to go in front of the immigration judge. He/She will see that you have a pending VAWA and will either stop the removal proceedings, or delay them until they have made a decision on your VAWA..

I really hope that I will get approved soon .... I don't know what to think... USCIS tocuhed my case 4 times in a row! I don't think that I read that anyone's case got touched 4 times in a row without any RFE or approval... Oh Dear God I really am praying that it is an approval..

It seems like there is quite some action... It seems like tuna is about to get the approval and 3bvsla is about to get the PR. Good Luck!

tuckahoe - hang in there, tuna is right, no one listens to an abusive spouse since they can go to any extent to cause trouble. These abusers don't deserve the attention and should be punished so that they don't put other people through the same thing again... maybe one day they will have laws in place so that more people don't have to go through what we went through.....

As for me, still a waiting game. I just noticed that they touched my approved petition and I am guessing it was to update the system on post-decision activity. Not sure when my next interview is and can't wait to put this all behind me. Will update everyone about the interview once I have one.

Hang in there and keep praying and think positive. Try to shift your focus on other things like work so that you are not driven by the anxiety of waiting. I know it's hard but it helps. Good Luck everyone!

On 10/03/2010 they also touched my approved I-131 along with the I-360... Did they do this to you too?

Hi all,

Looks like interview of your i-360 or biometric notice or automatic prima facie renewal .there is no errors on the uscis system .they work hard 24 /24 for keep everything Up to Date including weekends holidays .people got approval on 4th of july .if your case Toushed Someone open your file . the toush always MEAN receive or send or Review

I wish my journey End soon .so tired of waitiing almost 7 years , when i am gona get maried again ?:blush:
