I have been reading this forum. I am thankful to everyone who shares your experience. This seems to be a long journey and I hope I can find some support and support others here.

I am a husband of a USC, married for less than 6 months. Separated when she was arrested for DV and charged and pled guilty. She could not control herself. Family introduced us. We dated each other for not long before the marriage. I work FT. I suffered 7 instances of physical abuse. Only the last one was documented with a police report, pictures, court record, a final criminal protective order and her pleading guilty. I could not handle it anymore because I am afraid of being killed. She is crazy like that. A month into the marriage she became frustrated and showed her true color and started to become emotionally and physically violent, making threats of deportation and of using other people to harm me. She uses all these to control me. After the abuse she always tried to be nice and want to make amends.

I am preparing to file 360. Here are all the evidences I have:

A. Personal Statement (15-20 pages)

Good Faith

• Wedding Pics, Other pictures together

• Dating E-mails, air tickets, proposals, instant messages, wedding party invitations, cards from friends, etc.

• 2 Letters from people introduced us and from family and friends

• 3 Letters from landlord and neighbor saying we lived together

• Joint Lease, Joint Bank account, Rental insurance

Abuse

• 1 Police report

• Police reports when she violated temporary protective order

• Final criminal court protective order

• Emergency room Medical record for the 1 incident

• Pictures of injury with my nametag and date

• 2 Letters from my family who heard about her violence through me (no eye-witness)

• 1 Letters from social worker, 1 Letter from psychiatrist

Good Moral

• Police Good conduct Cert

I am thinking about canceling my lawyer and just submit them by myself, any advice? I have a valid NON-Immigrant status.

My Adjustment of Status was APPROVED!!!! this morning. YaaaaaaaaaaaaH!!!

My AOS Interview went well this morning. The Interview process took less than 10 minutes.Very quick!.. Interview time was 8:30am and I was there by 8:15am...I was called in at 8:35am..The Officer was very cool and friendly. He led me into the room and told me to raise my right hand up for an oath. Then he started asking for my Passport, ID and I-94, I immediately furnished him everything he ask for, then he ask me when is the last time I've seen my ex-spouse and he ask for Divorce document and my Birth Certificate, I gave him those as well. He made me relaxed throughout the Interview process. He then started asking the Yes & No questions, when he got to the Criminal section, he ask; have you ever been arrested or charged with a crime and I said yes that it was connected with the abused I went through and the Charge has been dismissed and expunged. I immediately want to furnished him the documents to back it up and he said he doesn't need it that he already review and researched my case that am fine. I was immediately relaxed and he said am going to Approved your case Congratulations, he started writing some documentations note with Red pen at the right Official Only section of my I-485 Applications. He shook my hand and he said do you have any questions for me then I said when can I get my green card then he said in 2 weeks then he smiled and he patted my back and led me out of the room and he said Congratulations. I am now free...I am so Happy.Thank you Jesus!

congrats Victoryismine.. we have one more victory in the group. its nice to know group members are getting approved but also frustrating and a test of patience for others.i hope everyone gets to where they want to be soon.the site shows my card production has been ordered, so hopefully i will see something soon in my mail.

looks like your case qualifies for 360 and as long as all the evidence required is presentable you should be ok.I do not know if the group would agree with me but my case went smooth because i used an attorney, if you are working and can afford it, i would recommend it.

Others in the group who filed by themselves can share their opinion so you could make an informed decision on how to file.good luck to you.

looks like your case qualifies for 360 and as long as all the evidence required is presentable you should be ok.I do not know if the group would agree with me but my case went smooth because i used an attorney, if you are working and can afford it, i would recommend it.

I say you don't need a lawyer you can do it on your own. Everything you have so far is good. It's the same as what I submitted with my application and I was approved without a lawyer. If you feel you need a lawyer and have the money then go for it. I saved myself money that I did not have by doing it myself. I was scared during the whole process but it worked out. I am now elegible to file for my citizenship and again I am going for it on my own. I think really help when you have a complicated case or criminal background. I would like to also say that, you should not be afraid to go to your local USCIS office to ask questions about filling out the forms, etc (schedule infopass). I used to do it and they were really nice and helpful (then I did not know about VJ I felt alone). I know this process can be so overwhelming and scary. Good luck.

Langa, Thanks for the reply. I have not sent 360 yet. My spouse and I submitted a 130 and 485. I went to the interview alone last week and told the officer to give me time to file 360. The officer said she gonna put it on hold before denying it. I wonder if someone here share similar experience. How long will they put my 485 on hold? Can I link my 360 to the old 485? I still need a few more weeks before I ready to mail 360. Thank you all.

The officer said she gonna put it on hold before denying it. I wonder if someone here share similar experience. How long will they put my 485 on hold? Can I link my 360 to the old 485? Yes, you can send or i dont know if you can handover in person a letter to your local service center where your case is pending. request in the letter to withhold the 485 based on the 360 that you are or will be filing by a specific date.Its a long shot and driven my no standard ways as far as i know, they might hold it for you or they may not. my 2 cents would be to ask them to close or deny the previous 485 and file a new one just because the processing times are quicker these days for 360 and 360 based 485 than what it was when i filed.good luck again.

I had a similar experience, except that I went to a second I-485 interview 2 years after the first one by myself. My lawyer asked the immigration officer to hold off on denying my I-485 because I was going to file the Vawa. In about 45 days the local office sent me a request to submit evidence that I have submitted the Vawa in 30 days. SO they understand that collecting the information takes time... I am in no way defending them... It has almost been 4 years since I started this process and still no answer...

can you guys tell me what kind of documents i need for VAWA to get greencard? My husband has been abusive to me over the phone cuz my visa interview is not there yet. He is getting inpatient and says bad words.

It appears that you are only interested in getting a greencard. I could be wrong but you are really making it bad for others when you do this.

I don't feel I have made a personal attack against you because everything I just used came directly from your comments. I just hope that others do not have their relationships affected by your actions on this forum.
