I received interview appointment letter today for my I-485 Adjustment Of Status after my I-360 VAWA was approved on June 22 ...My I-485 interview was scheduled for August 18...But my I-485 online case status doesn't change from: Initial Review "This Case is now pending at the office to which it was transferred" and I wasn't scheduled for biometrics appointment but had one done by myself for my I-360 VAWA to prove Good Moral Character which the result shows No Record Found.. Am so confused and scared.. And also I have a misdemeanor long time ago..7 years ago was lied on and implicated by my ex-spouse and its included in the VAWA case but has been dismissed and expunged from my record beside that I don't have any criminal record. I can't afford my attorney fee to accompany me to my interview...please guys do you think there will be a problem regarding this or will I be approved if I go to my interview by myself..Please any veterans with full knowledge, I need an advice of what to do. I have a month before my interview. My interview appointment is so quick though I requested an expedite on all my case, I-360, I-765 and I-485 which was approved on February 18, 2010....Or is this normal processing...Please I need an intelligent and professional with full knowledge response. Thanks guys!

My Signature Timeline won't allow me to add more Timeline to my dates. It says exceed maximum..I don't know why?

No the last touch and update on my online status was on 06/26/2010, 07/01/2010 and 07/02/2010 when it says my I-485 case was pending at the USCIS office which my file was transferred to. Since then no touch on my online status...Untill I received an appointment interview letter scheduled for 08/18/2010 today in the mail.

today is july 20th. One thing that confuses and scares me. ok i am filing my vawa application this week. im just about done the Domestic violence counsel social worker letter thingie just got done after a month of waiting.. Ill probably get it done this Saturday for sure or hopefully next week.

My lawyer should sometime this month respond to my wifes request for divorce. Shes filing irreconcilable differences and ill be counter filing extreme cruelty based of abuse i suffered. The divorce should probably be around 3 months or more from now. i havent heard a concrete date set yet at all.

My fear is this. I send my Vawa application. they dont respond forever or only send a prima facie determination. now by the time this happens ill already be divorced.

What if my wife goes nuts and calls ins and tries to have me deported because i am a overstay? im a overstay of 23 years btw. Can Ice deport me even if i have a Vawa case pending? Even if I have a Prima facie case? Im just scared out of my mind. i have never committed a crime i just fear my wife would try to get me deported any way possible even by lying.

edit: what is prima facie really and does it give any benefit at all? does it help you become under deffered action or anything? im just confused. please bare with me i am an abused spouse with fear of deportation for so long from my wife's threats.

Hi Victoryismine, I am glad there is atleast progress on your case in this forum as wish you good luck for the inverview.

here is my 2 cents from my experience/observations/learnings (call it what you want :))

For the misdemeanor -as long as you have the documents showing the case was dismissed you should be fine.

For biometrics - you can call your local office and schedule a biometrics telling them that you are due for the i-485 interview and so you would like to setup an appt voluntarily to get the biometrics done.

the online status - you can ignore what the online status shows, because if your i-485 is in local office and if its not one of the main offices (like vermont, national service center, chicago and a few more), the status doesnt change immediately and sometimes takes months to change.so you are fine on that as well.

You should be good to go as long as you take the documents that you submitted and i think you need to carry you passport, i-94 and picture id. I wont be able to tell you wont get questions regarding your past but just answering them the way it is should get you through.if you are lucky then you wont get asked anything of the past and just the 2-3 minutes random and nice questions.

I hope you do get fortunate and have to be there only for a couple of minutes and walk out with a passport stamping.keep us all posted and good luck for the interview.

Like you advised I called USCIS National Customer Service Center 1-800-375-5283 and I got a Service Request for Biometrics Appointment regarding my upcoming I-485 interview which will be sent to me within 2 weeks...Just to be on the safe side, I prefer to get the Biometrics process over with. Am so excited and at the same time nervous but am positive that I will be approved for my Green Card because if I can be approved for I-360 VAWA with all these issues and situations..I will definitely be approved for my I-485 because it all connected with my VAWA case. My I-485 interview date is pretty fast because VSC just transferred my case to NBC on June 22 and NBC transferred it back quickly to my USCIS Local Office for Interview scheduled for August 18th... I can't wait for the day to come so I can be free completely! Please to all my friends in this forum that we have suffered together I need your prayers to go with me for favor and approval on my interview day! To those of you that still waiting for approval of one thing or another, hang in there your day of approval is fast approaching..We will all rejoice together..Good things come to those who wait patiently. Hello there,

I did have a record myself, some 7 years ago, n it had nothing to do with my spouse. A car dealer conned me out of $5000 n I was not amused. To cut it short, I got arrested n charged for tresspass, assault n battery, found guilty on ONE misdemeanor. However, I also successfully sued the dealer, fought tooth n nail n got my money back. Legally, I committed a crime by refusing to leave whEn he tried to force me to, but he also committed a crime by knowingly committing fraud. I got the record expunged, but I sent all the documentation to VAWA, with an explanation.

Infact, it was not mentioned at all, and my record called it a simple assault. The judge was willing to help out if immigration tried to use it against me, but they did not. Actually the IO at the interview smiled when he read about it. He actually said: This guy tried to con u and u got angry. He even apologized on behalf of Americans.

But I will suggest that u carry ur expungement record if you did not submit it. It obviously is not a problem, otherwise they'd not approve you. Remember, they do not just say ' u are a criminal'. They must look at circumstances and even consider how an American would respond.

An ID is an obvious thing to carry. Just carry yourself with respect and you will be fine.

after denied I recevied my package back.I sent this package back to uscis that this is mail's mistake I sent this package on time .after I sent I checked that

I guess if it says denied when you check online and they sent you a denial letter before, then your case is denied.

Next step is appeal.

Call Uscis customer service if you are not sure.

Dont Worry THERE Error they will process the case Again .if the luds change that mean they consider your response .

your case is Active now if they update the Luds on your case without status change .but you should Get information about your case .

FIRST OPTION

write letter to VSC .status inquiry . write VAWA UNIT on the envolop .

write letter to senator and congressman on your state to help you find out what is the current status on your i-360 .

write letter to Ombudsman office form 7000 http://www.dhs.gov/xlibrary/assets/cisomb_dhsform7001.pdf

write letter to cheif of homeland security Janet Napolitano .

write letter to USCIS director in DC .

if you do this i am sure you gona get response .

SECOND OPTION

even late now you can always file Motion to Reopen Denial By Submiting The Form I-290 B Together With new and Lots of Evidence Including affidavits from friends .the appeal should be strong with new evidence and letter and also affidavits from friends .

file just Motion to reopen ( 3 months process time ) .DO NOT FILE APPEAL ( 3 years process time ) ASK FOR FEE WAIVER FIRST AND SEE .they will send you receipt notice .

you should file since the begining form i-485 to be safe on the pendency of this i-360 to get and renew work permit to survive while your are on the process .always be careful .work permit is A MUST .stay in touch here .man i am so sorry .do you renew your work permit ?be careful if you can support your self i am sure your i-360 can be approved because is take time .

do the first option and let us know what they tell you ok .do not send any things until you ask on here what you need to do . do not file i-290 b until you get response from VSC .

send letters as soon as possible .

Hi Fellow members,

Two days ago, I got email from USCIS saying that my I765 was approved. Another email was sent yesterday saying that "production of new card" was ordered.

I was wondering in how many days I should expect to receive the EAD card, so that I can finally start working. Is it possible to start working based on the I765 approval notice? Or EAD card is absolutely required?

I have reviewed the time-lines for fellow members: colours, schatzi3277, lostinNJ, Manu, tuna_fsk and seen varying times in which the I765 EAD card was mailed (from couple of days to 2 weeks).

Also, I had a question for fellow members regarding what to expect next. Should I expect any movement on I360 in next 2-3 months? What about overseas travel, before I360 and I485 is adjudicated upon?

Congrats to Manu for I360 approval! I wish you all the best in I485 approval.

Around page 137, Kwala mentioned reviewing pages from 70 till present to get a good idea about the VAWA process. Thanks for that suggestion! I must admit that I have only read ~20 pages out of 142, but will follow Kwala's advice.

Hi, i am new in this forum but i have been following very close i have the same experience than you my work permit was approved on jun 25th and a week later other message they had ordered the production of the card four days later got delivered to my address. a week later a message July 09 they approved my I-360 and they sent an approval notice.(I don't have yet as they sent it to my lawyer and they are no nice i am afraid it will get lost)

I hope you will have good news soon.

This is not an easy journey as i recently moved from Virginia to Atlanta and i am really scare that the change of address will delay my proccess as i didn't expect that they would make a decision this fast. it took 6 months

my questions will be now:

what is next? i didn't start any process of divorce yet i know many of the interviewers ask for the divorce decree

please keep us apdate as what you got next.

I went to the interview alone, without a lawyer and believe me i was scared. I did not know what to take, no spouse no tax return from him and so on. I prepared a folder with copies of all the paperwork that I send to the USCIS and all the originals of the paperwork that i got from the uscis. I brought my marriage certificate, my daughters and my birth certificate, my divorce papers, my passport, all the lease agreements that I have since i lived in the USA, pictures to proof that my marriage was real. only 4 pictures, 1 wedding picture birth of our daughter and 2 with him and me together). I was dressed nicely. Arrived on time and waited for my name to be called. I was called by an older lady, very professional. She ask for my birth certificate, my passport and i-94w. Ask for the i864w, gave it to her. She asked me 5 out of the 20 yes and no questions. Then the proceeded to verify my adress and if that is were i want to receive my green card. She said she would approve me but we have to wait unti immigration decides on a new ruling on holders of the i-94w. we said good bye, she showed me to the exit and that was it.
