I went to the interview alone, without a lawyer and believe me i was scared. I did not know what to take, no spouse no tax return from him and so on. I prepared a folder with copies of all the paperwork that I send to the USCIS and all the originals of the paperwork that i got from the uscis. I brought my marriage certificate, my daughters and my birth certificate, my divorce papers, my passport, all the lease agreements that I have since i lived in the USA, pictures to proof that my marriage was real. only 4 pictures, 1 wedding picture birth of our daughter and 2 with him and me together). I was dressed nicely. Arrived on time and waited for my name to be called. I was called by an older lady, very professional. She ask for my birth certificate, my passport and i-94w. Ask for the i864w, gave it to her. She asked me 5 out of the 20 yes and no questions. Then the proceeded to verify my adress and if that is were i want to receive my green card. She said she would approve me but we have to wait unti immigration decides on a new ruling on holders of the i-94w. we said good bye, she showed me to the exit and that was it.

Hope that helps anyone that still has an interview to come.

Thank u Kwala for breaking up everything for me. I have been reading alot in the internet and saw that I am supposed to reopen my deportation order within 1yr of the order. I asked my laywer about it and he seem not to understand what am reading but he said that VAWA cases do not need reopening. Pls i will appreciate if somebody has this information. Kwala do u know if i was supposed to reopen my deportation order case with the judge before filling i-485?

The judge know by VSC you are a victim of domestic violence he will never contact you .you are not in proceeding now ,the defered action mean deportation Terminated Finish mean END . and even uscis will not deport you and alow you to stay in the united states for 15 months to adjust your status .ONLY people in deportation Order by judge to leave the country in 30 days Can file motion to reopen judge order of deportation to BIA .Board of Immigration Appeals .and then there is one court higher than others . you can appeal the appeal of denied appeal for 12 years .

when the i-360 approved ,everything is dismissed including your spouse is not even credible of what he is already file for you or inform uscis against you .the judge will contact you the time you file your i-360 because VSC always have comunication with the court handle your case .but what is hapened .VSC inform him that you are elligible for VAWA .and you are found to be victim of domestic violence and establish prima facie case .then the judge dismissed the case toward you for ever .

you should stop looking .looking .looking for something you dont need it .you will get green card in 2 weeks after interview or more days .you dont have anything to worry about now .if something hapaned about your green card ,VSC will contact you to request more info .that all .then you can share the problems on here and your case will have the light that VSC have No way to cover it .

you should start take care of your self now do not contact attorney anymore or Bother uscis all the time you contact them will stay on your record .you are fine now and just wait for the card less than 30 days .

it aint about how hard you hit .its about how hard you can get hit and how much you can take and keep moving forward even broken

Hey guys how are you? I was just going through some of the post. Remember if you are in a VAWA interview and you feel uncomfortable with the questions or you feel like the Officer is asking questions that he/she is not suppose to, you can always ask to speak to a supervisor. There is no harm in asking for a supervisor. Just don't get nasty with the IO, ask him/her nicely for a supervisor.

why are they takig so long... i have a question. My fingerprints were done initially whan my spouse filed for my I-130 , will thy be doing it again since i have the same A# number that was assigned to me previously. Any experinces

they will not call your kids for interview. I have question. On 3/12/2010 what evdience of abuse you send to VSC. I also filed WAVA and have similar RFE. I have to reply for same as VSC is saying that my marriage just fell apart and they need more evidence plus the letter of good conduct from another state where I live for six months. I am given month and half and they need affidavits from friends and family but I dont know what should be written. I don't have any police report because there was no report filed with police I am still afraid to loose my kids as I am not USC or GC holder. My x has the temp custody only because I don't have any status Judge told me that on hearing.

Let me know what kind of matter should be acceptable

May 26th, 2009 : WAVA filed.

June 1st, 2009 : RFE issued Good moral: replied june 15th 2009

July,17 2009 : Prima facie approvel received.renewed again march 3, 2010

February 2, 2010 :I-765 filed, : denied

August 12,2010 :RFE issued on WAVA, more evidence needed.

sept 3rd 2010 : I-765 filed again. 9/15/2010:Filing receipt received.

Sept 15,2010 : REF answered with all evidences.9/17/2010:RFE recvd by USCIS.

Sept 19, 2010 : I 765 approved.

Sept 19,2010 : I360 touched. status changed to RFE Under review.

hi Pascal

First of all do not panic , i felt the same whan i received the RFE to prove abue but some members like Schazti / Bensheriff, kwala they all helped me to manage the situation. I m telling yu what i got as RFE and what did i send to overcome the RFE.

Firstly my case did not involve any police report , medical report or any shelter , social worker recommendations. All I sent them was my statement and statement from my one co-worker and my brother. My self statementb was 42 pages where i explained every detail officer wanted to know. when you recive this RFE basically officer want to know three things.

1. dynamics of your relationship with your spouse.( which basically means why your spouse turned abusive when you both married in good faith)

2. Effects of abuse( explain your life before abuse , during abuse , after abuse)

3. any witness who have personal knowlede of what you went through.

Now in dynamic of relationship , there has to be a convincing reason for your spouse to turn abusive, it could be kids, parents, finances, your way of life, drugs, alcohol or anything.you have to tell officieis what you think is the reason why your spouse turned abusive from being the love of your life. ( ONE STRONG CONVINCING REASON)

Second bfore the abuse or you can say before your marriage and till the abuse started.explain officier how did you meet , where and why you found her to belove of yur life, explain every detail with correct or nearly correct dates. what made you decide to marry her and how long had you guys known each other before marriage. was everybody happy with marriage . Now when you get married the real life probelms started coming up like money , bills and everything . was your spouse ok with it ,

Now the abuse part, what did your spousedo , how it made you feel like.was it possessiveness , control, threats or intimidations to harm you , abusive wods, but make sure what ever you write should be situational and briefly explained. did you talk to anybody for the vent , did your spouse leave home at all leaving you, was you embarressed / ashamed in front of people and friends,. how did you manage th situation , did yu haveto live scared so tha your spouse does not harm you.

SO MUCH TO WRITE !!!!!!!!!

finally the support docs have to be like rport from Psychatrist , affidavits from friends who have a personal knowledge.

I don't know what the new ruling is. The officer did not mention anything. She told me I was approved, but that they are trying to come out with a new ruling. It might have to do with that of July 2010 all the i-94 and i-94w will be electronic, no more papers. But I try to stay positive. It has been almost a month since my interview and I have not received anything, good or bad. So we will see. I have my work permit, drivers license and social security number, so for now I am fine. I t just would be nice to receive my green card so I can finally go and visit my family. I was married to my husband for almost 8 years and he never filed anything, so it has been a while since I have been back home. So hopefully soon, and I can take a vacation.

one question??

Do The IO take the 1-94 and stamp your passport at interview. Do you have anyinformation as when do they actually send your physical green card.

The IO took my i-94w but did not stamp the passport. The only time your passport will be stamped if you were approved right away.

Hi Anonymous09, same here. Nothing happened since the 26th of June. I'm so frustrated at this point. The 60 days have passed and I'm wondering what's going on!!!!!
