an immigration lawyer adviced me that I cannot apply for self petition (Vawa) if the divorce is not yet final, so wait. My soon to be ex (can't wait) abuser husband is doing all kinds of delay tactics knowing we have no children

You immigration attorney he is wrong you can still file for vawa while you still married and if you approve the abuse you can expedite your vawa because you still live with abuser

Anyone ever hear of I-485 denied after I-360 approval?

Denied email received. Does not say why the 485 denied but say it will stay on the letter mailed. How is that possible to deny a 485 when the 360 was approved?

Any help or information would be great!!

the approval of i-360 is not final yet ,until the interview to fce question or some issues concern .employment hidtory .you did not report chenge of adress to uscis .and the officer interviewing you may he found or discouver from what you said a new reason to deny the underlying approved i-360 .that hapened always when some one have an approved petition and at the interview stage he cannot explain on the claim of abuse or good moral charachter .also some victims of interview get denied because .not feeling well to be interviewed .so sorry very deeply .is terrible .you should start motion to reopen if you recieve denial of the approval of i-360 .maybe revoked because something comeup against you .every probleme have solution you should be fine if no record against you by the law .you can get approval again of you folow motion to reopen .good luck .

I filed my vawa in 2009 I got work permit and prima facie. in 2010 they send me 2 times rfe I sent them.unfortunatly when they denial my case those papers came back. I sent them back that this is not my foult.they did not send me any recept but I checked my profile the date was changed 3 times can some one tell me that my case is still in process. or case gone in panding.thank you for answar or thank you for no answer too.

you did not show up at the interview date .they send you interview notice after fingerprint notice normally 1 week .

Thanks 2chro2015! I am still waiting for an approval so as of now my case is still pending. To answer your question, I have an attorney who is representing me but I have been doing a lot of the homework as well and making sure I have gathered all the required evidence. It is possible to do it yourself, but I just wanted to make sure I got some legal help so that I don't miss anything. I understand it is hard to afford one and I had to borrow money to afford one. There are also lawyers who help "pro bono" meaning at no cost. Let me know if I can be of any help in this difficult process...

hi ghazal , sorry to hear about the dificulty you are experience on the proces about your case . that hapened most times ,because they dont get your response timely mean they denied it for not respond ,but befor they can deny your case they should by law of uscis to send you notice of entend to deny then they can deny it ,but on your situation they deny your petition bcause no response recieved by the time they request .even you send the response .it was not recieved and the whole response back to you because the adress is not corect .this is not a probleme at all even your case denied now .you should relax and just resolve everything in real way .you have evidence receipt of the post office that you send the RFE timely then you send them back to ask the service to consider this probleme of post office .of course they will recieve the RFE you send after that the VSC will think what to do and inform you ,now you said your petition is denied but did you get denial notice said you should file appeal i-290 b .if so you should do it in 30 days .with fee of 585 $ .now you should wait for the new decision and dont send appeal .if they deny it again you should go for motion to reopen .

if you work now and the situation is okay but your should always renew your work permit to be fine and fight your case .you should wake up .try to send motion to reopen i-290 b .with the evidence previously submited including the evidence of the post office that you send the RFE timely and that the decision was wrong because of the RFE not receieved by VSC ..

you should contact the senator immidiately and ombudsman office form 7000 also chef of homeland security in DC .defend your self with peace of mind .

if your case was toushed 3 time is good signe .GOOD LUCK

I have my interview coming up soon. I had two biometrics because they could not read my fingerprints on the first one. Retook them April 12 and got the interview letter a month later.

I did have the senator did inquiry for my case and she says the application is currently with an officer for adjudication that what they told me every time I do inquiry thru the senator

Do they really work that quickly with so many touches the same week once you send the RFE? I am getting nervous but hoping for the best. I have suffered so much already and my spouse still continues to give me grief. I can't wait to get freedom from that jerk! I want to be able to breathe peacefully...
