Hello everyone,

I'm new here and I'm just about to start to file for a VAWA case for myself. Could anyone advise me if I have to hire a lawyer for this. I prefered not because I couldn't afford it. Has anyone experienced of filing their case by doing it themselves and without a lawyer?

Please help. I will highly appreciate all advises.

Sorry to hear that you have to go through this. Well, to answer your question, a lawyer is not necessary but quite helpful. There are many lawyers out there that provide services "pro bono" which means at no charge. If you contact a non-profit organization or anyone recommended via the National Domestic Violence Hotline, you may be able to find one.

As for the process it really depends on your case. It could be strong or weak but that doesn't mean that you cannot get approved. You can always give it a shot. The first thing you may want to do besides finding a good lawyer who has successfully worked on VAWA cases before, is to gather all your documents and evidence. Not sure about your situation but feel free to share more if you need any help with what to do... especially if you choose to do it alone. I will be glad to help you out with putting all the details together since I am already going through this unfortunately.

Yes, you can totally do it by yourself. I strongly recommend to everyone to do all paperwork by themselves and hire lawyers only if they have to go to Immigration Court :) It's really tough to find a lawyer who actually has experience with VAWA. Good luck.

November 25 2008 RFE #1 received [good faith + good moral character].

January 7 2009 RFE #1 sent back.

Yes I have. Without a lawyer too, and a criminal record to boot. If you trust yourself-are willing to read, and re-read and do research, you do not need a lawyer. Do not expect immigration to translate anything (maybe she means this or that), be very explicit. They want A, give A, or explain why A is missing (convincingly).

prepare ur self for INTEND TO DENY ,the same thing hapened to .the approval come befor 45 days for sure after that the officer is prepare the intend to deny .i got it after 56 days after sending RFE .u can work hard and resolve ur case its easy just fix what is wrong . :)

I am sorry to hear that you have to go through this progress. There is no need to hire a lawyer. It is possible to file on your own. I have filed my VAWA on my own and I got approved in 180 days. Just ask if you need help.

I also have a question for the group. Does anyone know if i-485 can be done via premium processing, i am fed up waiting and want to visit my family back home.

I filed my 1-485 and i-756 cocurrently with I-360.

I sent Marriage certificate, utility bills, insurance papers and the the form.

I filed it under c 14. C 14 you file when you got put under deferred action after the approval of your vawa case. You get a letter which states you are put into deferred action for a certain amount of time. C 9 you put in when you file concurrently for your adjustment of status as a spouse of a usc and so forth. I did not send a letter or proof of economic necessity since i filed under c 14. If I reapply for the EAD i would have to proof it. This time I only send the waiver for the financial support with the AOS and EAD together.

now u gona get response befor 60 days .if you send all the requested documents .if the officer still not satisfy or convainced .he will send u 2 request for evidence .most members get 2 RFE .i got just one but my petition denied .i do an appeal .only 2 cases and mine approved from 400 petition last year 2009 .

eeverything is clear u should review all your documents and send what ever u have .but wait now is no time frame on this RFE because every case is difrent .sometime take average time wish more than the time on the case status .wish you good luck and everyone on here .i am truly become sick of this situation .

do u put c(9) on EAD or c(14 ) ?
