Guys im being paranoid with my situation, im out of status, my visitor visa has already expired, im i still qualified to file self petition? im afraid uscis might get alarmed with my current situation. anyone who been in my situation. thanks

what i learn 4 years ago .that people in removal proceeding file i-360 .people have order from judge to leave in 30 days and file i-360 .file the petition and is long way to go even at the courth the judge will repen ur case of removal .is too much to say about stay of removal even u are in that such situation .u should file it soon good luck from a clean and sincere heart .go for it dont worry .because i-360 filed no one will deport u or put u in removal until decision made on ur petition could be finish in 3 months or 7 years of process .

most of those friends on here not regret because your delay to file this petition is not on ur favor.u should start colect any evidences now and let us know we may help u what kind of evidences u need to have very good case .even u dont have police report u should file it soon and the begining must be well documented because the RFE will be clear and not going to be in the descranpancies .on ur statment u should write everything hapened to u phisical emotional verbal ,if calling u names or insult ur familly .force you to do things ,control over your money ,not allowing u to have the mail key for ghatering the evidences ,insulting you in front of ur friends ,or made u sleep on the floor or make u in trouble at work with ur emplyer .if ur spouse have other relationship with other person .u should write anything hurt u in the relationship .if ur petition denied after REF ,INTEND TO DENY ,DENIED ,u may appeal the decision to higher authority for further consideration .you can appeal denial of appeal and USCIS never close any case even denial will always willing to open any case .

you should explain ur situation as well as your current marital relationship .dont be shy on here all of us was abused and homelesses and humiliated No one look good r perfect male or female .well most womens have chance for approval if they could show each of the requirements requered by uscis service .

you should file your application concurenthly with new i-485 and i-765 to be in safe way then your i-360 should be accompagned by a good statment showing the all the threatments that u have beed trough on your marital relationship including the phiscal if ur spouse ever push u or pull you or kik u ,and emotional abuse if ur spouse used power tools of immigration to deport u u should describ all of those events on ur statment .

the adjudicator unreasonably rejected the independant evidences and keep requiring unresonably specific documentations .is violated Congressional law as well as intend ,established rules and practices of the Citizenship and immigration services .as well as standards set out by the ninth circuit court .

Congress , USCIS and the courts CLEARLY Required that any credible evidence should be accepted for VAWA self petitions ,and a broad and flexible standard of evidences should be utilized .

Congress has Repeatedly Expresed its intend to protect battered immigrants. for instance ,adopting the battered immigrant female /male .protection ACT of 2000 ,it stated : the goal of the immigration protections for battered immigrats included the violence against woman /man ACT of 1994 was to remove immigration laws as barrier that kept battered immigrant woman /man and children locked in abusive relationship .

in seeking to protect battered immigrants ,Congress Regonized that the dynamics of violence as well as unfamiliarity with the society and dominant language made it extremely difficult to provide evidences traditionally required in immigration petitions .therefore ,Congress Specifically Established in INA & 240 A ( b)(2)(d) that any credibles evidences TO BE CONSIDERED to determine Eligibility .CIS has long abided by this mandate ,and has adopted policies to make this clear to its adjudicators ,For instance in a Memorandum Circulated to all Directors in April 1996 .

mmigration services made clear that in the adjudication of vawa self petition the adjudicators must Consider all relevant credible evidences submited ,and should not be rigid in the evidences that he or she accepts .

the any credible evidences Requirement in all vawa self petition in order to make it easier for battered woman/man /children .to prove spousal abuse .

the adjudicator erred in requested unreasonable restrictive and specific Documents

further the adjudicator demonstrates a significant lack of understanding of the dynamics of domestic violenece for battered immigrants ,in requiring that witnesses who submit statments must be notarized and be willing to testify befor immigration service .this shows a profound insensitivity to the fact that such a requirement would make it virtualy impossible for self petitioner to get declarations from witnesses ,because most witnesses of abuse against immigrants are themselves immigrants and unwilling to submit such affidavit that are notarized and would subject them to questioning by the immigration services to be deported as a result .

usage of the impropre evidentiary standart is a serious matter ,because it will severely prejudice VAWA applicant by creating impossible burdens on them .such excessive standards will in particular prejudice low income battered immigrants ,who are often unrepresented by ligal counsel or who are assisted by nonprofit organisations wish are under resources and overburdened ,this goes against the Congressional intend to creat more flexible evidentiary standards in order to allow battered immigrants access to protection under the LAW .

hello everyone.. I think this is good news for me.. the site says my i360 approval was mailed to me yesterday. I am not sure when it would reach me but i see some light at the end of tunnel.thanks to everybodys goodwill and my best wishes for everyone going through this tough journey.

i just applied for the I360 last tuesday based on abused or battred husband i been abused menthaly and phisicly to

the problem is that i dont have statment from poeple that they know us because was all her friends and the refuse to say truth or even answer my call but i stumbit

1 report police ( domestic violence)

2 my medical record because i attempting suicide when i find out that she was cheating on me and withdrew the I 130 even when we was living togather....

3 officer counslor for marraige statment

4 proof of resident togather like insurance and bills

5 proof of good moral charectar

but the problem i am worried about that i dont have statment from people that they know us like friends because the refuse to say the truth

my question if that enough proof or must that i have statment from other people ? please help me out

sahbna u dont know anyone on planet ,u dont have familly ,brother ,sister ,dad ,mom ,your previous boss anyone friends u meet somehwre coffe or any place ,even they are not eyes witnesses there statement show that u report the events and they live the events u go trough ,is a game relax and fix things in the good way .first things do not send any affidavits until the service ask u .u should send affidavits if u dont have independence evidence but u HAVE more than enaugh .if you send independence and credible evidence (too much) will damage ur case .
