I filed for VAWA on Oct1st -09, Received my Prima Facie in 15 days. Since i had not hard anything till March -10, i requested my lawyer to request for response. Now on 12 March 2010 , i rcvd the RFE for good faith maraige, Moral Character & abuse. I had set all the docs with my petioiton . why isthe IO asking for the evidence again.

Please advise what should i do .

its normal that VSC send you RFE most member her got RFE ...but you have to gather as much evidence you can bc/z the ask for 3 thing and I’m afraid that your case doesn’t look good you don’t send sufficient evidence from the first place don’t worry just try to get as much you can the more the batter

good faith marriage

Any joint account with your name and your ex spouse such as lease credit card bill insurance vacation picture marriage certificate etc .or affidavits from mutual friend letter to each other your own affidavits that you did love him/her and you did dream to have nice family and life with him/her

Good Moral character

You have to go get your back ground check from the places you did live in the past three years you can have it don thru the sheriff county in your state and if you been convicted of crime the judgment entry of the conviction . Basically you to send your criminal record history

Abuse

You have to approve that you been abuse such as police report if you ever call the police in your ex spouse your own affidavit (you need to be full of details )and if you can support you affidavit with any evidence and any letter from people that witness the abuse and affidavit from mutual friend are good too and if he/she have criminal record you could submit that too the abuse is critical part of vawa you need to supported with evidence

2. photographs after mrriage with her & my family.

3. Marriage cetificate.

4. Rental agreement in both ournames

5. Joint Bank account statement

6. Joint rental insurance.

7. Utility Bills.

Abuse.

2. affidavits fro two witnesses.

3. My statement.

Report from California department of Justice.

Police verificatio letter of no criminal record.

That is why i am worried as what else evidence thy need.

Hi Manu,

did u make any copies of what u sent? if yes send them all again, sometimes lawers make mistakes and dont send the whole package, try to add some more affidavits and personal statesments regarding the good faith of marriage and abuse. N just wait. Chin up and Good luck:))))

Just send everything again, and maybe the children's birth certificate, if you are both the parents. It looks like you have a lot of evidence, so resend it and keep your faith up it will all be fine.

Thats just weird to me that they actually issue prima facies and then request a lot of evidence..

Manu, send the same evidence again, and add several comprehensive statememnts from witnesses and from yourself.. that should work

Thanks for advice. I am thinking the sae but my l;awyer says he is looking at some legal angels i don'tknow what. He has not even bothered to call me & tell me what he is planning to do. He charged me 7000 us to file the application and now that i have paid him when i rcvd the rima facie he is not serious abt it.

I am so f****n irritated.

Some lawyers are just wasted time and your money they dont even pay attention what the case they handle ..

But In my situation right now I think I'm comfortable with my lawyer she didn't even charge me any amount..

so sorry to hear that but is good to know what you need and is good to relax and think good about what you have to do now .

you must work hard to colect all the evidences you need to overcome the officer RFE

all the evidence you send previously is insufisant and you need to give them more clarification

about good mariage faith you have to write other fidavit and convaice the officer that the form i-485 filed by your husband is eveidence that ur mariage is good faith including but not limited to .

joit account is good and accepted the officer want give u hard time but the accounth is accepted most time by highr autority like AAO .

the afidavits from friends will work better ,you should send minimum 6 letter from friends for eash request for good faith 6 letter for good moral charachter you need the 6 statement for abuse you ned 10 statment if you send less letter than thse you are denied .

try to colect all eveidence you have even you dont call the police you should write on your statment that your call or report to the police will end your life with your kids because our x have control over your life ,

the good moral charachetr you need to send letter from friends 6 letter minimum .

background check from eash place you live since you come to united states .

buckground check from your country showing no record .you need this one ofcourse

FBI fingerrint check you can send fingerprint card to FBI yiu gona receive response oin 3 month even you will not able to send it now with your RFE responce but maybe of course you need it for the next RFE REMEMBER .YOU HAVE WEAK EVEINCE ,you should colect all this things i said .

you own afidavits write the whole story since you meet your spouse .be carefully about the dates .USCIS plays as well on the dates .if you said on your afidavits your spouse hit you upsters dont say again hit you downstairs be carefully from descrepamcies and consenstency .reveiw your affidavits good befor you send it also the first one you send .try to see if the date you said is corect be careful your affidavits is very important also the emotional abuse not sufusant to prove the abuse .you have to include phisical abuse on your statment afidavits that you been in phisical abuse .the emotional not working on this with uscis .

-pics of injuries or damaged property .

-lettter and notes from the abuser may revial agrissive and abuse have taken place if you have any of those letters send them .always keep copie .

-tape recorder of your spouse speaking badely .

-psychological affidavits from any doctor .

-10 lletter from friends .any just do the best you can dont be why just ask any one please i need letter and is easy dontr be afraid or shy ask ,

-try to go to court and ask for your spouse background check if she /he has record or crime send those report and any ticket trafic or credit bank your spouse owe to bank they will help you to prove that your spouse abuse you becasue financial probleme .

you have bad case like mine exactly and i am afraid that your case need 4 years to be resolved ,is better for you to colect the best you can i dont want you to be my my situation god knows evrymorning i wake up i wish if i did not wake up and think about those who play with others life .is not fair CIS OMBUDSMAN KNOW THAT AS WELL THAT WHY THEY DO THE BEST TO FIX uscis broken systeme but no one listen to them just wast of time .

you have good evedence but you should explain on your satment those evidence you send him good luck .

We did not have physical fight as my kids were always at home so i do not have any pics, she used to pinch miy kids, lock them in room & scare them so how do prove this.

we do not live together now so what doi send. I have reports from my psychtrist which explains the trauma i had gone through. Also being a man my wife never dared to hit my kids or me.

we were married for two months when i found out that she is a lesbian & is having sex around with her GFs & tht is when the rift started.

i do not understand how i prove the Emotional , Neglect the huilataion i had to go through due to her sexual ######.

the affidavits is just a letter from all the friends or emplyees that you know .just need letter from them but first handship always necessary mean how they meet you on the letter .the good faith also same but just friends showing i=on there letter that they see you with your wife together and always care of each other .not needed to be notaresed or any ID .you need 10 each ,

about the abuse if you dont have police report or pics .you have to explain that she is puling you from the bed and hit you by phone and tv remote control .if you dont show phisical abuse on the afidavits just withdraw your application .

-two police report

-pictures of injuries

-pictures of damaged own property in the house

-tape recorder of my wife speaking badely and aknowledge by hit me 6 time on my lips until the blood comeout .

-letter and note from my wife threat my immigration status and treat me .

-her bad record her background check .

-her profile where we meet that she is lie to marry me on her profile show 28 and she 61 now . GOD KNOWS I DONT KNOW SHE IS OLD BECAUSE SHE IS criminil usc

-2 PCYCHOLOGICAL REPORT .

-13 affidavits from friends willing to testify by USCIS local office .

my case stil pending 4 years .i send letters for assistance to obama and his wife .all senators and congressmans on the senate .head quarter in DC .director of USCIS .cheif of AAO /secretary of homeland security .chief of homeland security .uscis CAO customer assistance office .governor of georgia .Eric holder department of justice .

i am afraid to lose my memory 6 WHOLE YEARS IN THE NIGHTMARE .I JUST WANT uscis to folow the law .i gave them what they ask for .i want my case to be aproved IMMIDIATELY people

it was denied since july 2007 but i appeal on august 2007 since then THE IO put the case on the shilf for 2 years until i contact the white house .then the IO adjidicate my case have 1 week to forward the case to HEAD QUARTER for THERE RECOMANDATION because he is stuck with that bunch of evidence he is afraid to aprove it because my be want give my aproval to someone else .because he only have 2 U TURN WHERE YOU COME FROM VISA ( u) .then he send the case or recomandation he need adivise he is not know how to adjiducate i-360 i swear to god .he need advise and someone to told him to aprove or deny the case he is stcuk but i am the loser for those years .the officer have his wife and kids and house and car and bed to sleep after work .but i only have allah .

that why i told you to send much eveidence you can because just few visa ( U ) turn where you come from left .is for woman only 95 % aproved men 25 % .
