You need to write to USCIS and request an extension of your prima facie. You can use the primafacie to extend your driver's license. It can be a one sentence letter:

Dear sir/madam,

The purpose of this letter is to request an extension on my prima facie which has expired. My receipt number is EACxxxxxxxxx with an expiration date of xx-xx-xxxx.

Make sure you include a copy of your expired prima facie.

You have nothing to lose by writing to request a prima facie. If they are working on your case right now and have approved you, they will send you an approval. If they haven't gotten to you, then they will send you a prima facie BUT at least it will remind them that you are still pursuing your case.

I filed my case at the beginning of April 2008. I received a total of 3 prima facies and I had to request all of them. They don't just send them out. If you read your prima facie carefully, it tells you to write to them 15 days before it expires and request a new one. I didn't read that and I was waiting for my prima facie for about a month after it expired. I finally read it and sent a letter requesting it. The only exception is the 3rd primafacie which was only good for 60 days and it did not say that I could request another one after it expired. It simply said that my case would be adjudicated withing 150 days. But when it was about to expire, I wrote a letter requesting an extension anyway. I figured I had nothing to lose. The worst that could happen was that they would throw my letter in the trash. But it made me feel good to write it anyway. I sent the letter on May 4th 2009. I received my approval two weeks later. I am not saying that you will get an approval notice by writing this letter. My point is that you have to be proactive.

Hi Eva, did USCIS ask you for RFE? I was mostly abused verbally, mentally and emotionally, it's embarassing to admit but I need your advice. I won't go into details about the physical abuse. But I did not report any of these with the authorities because at that time I thought I could handle the situation and besides my family and relatives were close by.

What more can I send them to prove extreme cruelty? I was taken to the ER twice but because of migraines and not being physically battered. We don't have joint bank accounts because he did not want to. His car is in both of our names and that's just about the property we own together.

He was very posessive, he flew off the handle when I went to the movies with my female cousin. He was constantly reminding me that I'm breaking the law for working without authorization but he keeps asking for money. When I received a gift card from my aunt, we ended up using it to buy his clothes. But I can't get letters from the people who witness his cruelty towards me because most of them don't know of my legal situation. And besides, I don't tell my friends that I married an abusive person. I really don't know what to do. USCIS gave me until August to send them more evidence. HELP!

The sexual abuse was a big component in my case. Like you, I did not confide in anyone about what happened to me. I was so ashamed of myself. I couldn't tell anyone about it. I cried myself to sleep every night. I hated myself for staying with him. But I loved him so much. I hated him so much.

I fell into a depression the months following my filing and saw a counselor who suggested that I see a doctor regarding anti-depressants. It felt good to talk to her. And she wrote a letter in my support with regards to my depression. I sent the letter in January, 9 months after I had filed. Since I didn't have police records, I made sure that my declaration really expressed what I went through at the hands of my husband. It took me two weeks to write it. I cried every time. It was 14 pages long.

Hi Eva, I went to the police station earlier this pm to get police clearance, I was nervous, but they just asked for my driver's license, it doesn't matter if it was expired, I waited less than 5 minutes and paid $5.

I'm going to try to renew my driver license this week with my prima facie (expired a week ago). I will let you know what happens.

LostinNJ, bubbles14la and Niagara, I can't wait to hear that at least one of you guys got approved!!!!. My biggest dream is that we all can move on with our lives shortly. It's been such a long time and we need to leave behind all the stress, tears, sorrow, and suffering that we're going thru.

Hi LostInNj, I live in NJ as well, you can not use Prima Facie to renew Driver's License, you need six points. Visit NJ-DMV webiste; SScard is only 1 point, EAC is 3 points but an approved form I-797 is 4 points. 1-point documents can not be used twice so I think we're going to need EAC before we can renew our license.

I actually contacted the NJ DMV today, you're right, can't renew with prima facie, infact, seems like I can't do a damn thing with prima facie, I also tried applying at the school for financial aid, I gave them the prima facie, I can't use it because I don't have a social security card/number, and they have no clue what the document, I've tried to explain but they don't get it, so I'm just really disgusted. I'm really over this situation and strongly considering leaving the united States. I'm just exhausted and mentally damaged.

i know what you going thru b\cz all vawa poeple suffer like you and every body is exhausted but they is nothing relly you could do look at me i been her almost 7 years and i dont have my green card put up with crazy wife and after all she try to call INS on me and send them nuber of letter and now delling with VSC agine its been over 9 month dont her any thing just try to clear your maind and try to forget somthing call vawa

Hi there, don't give up. Things will get better, I assure you. If you leave the US, you can never come back or it will take years before you can. You've waited so long, what's several months more. hey 3bvsla congrat ........that good news but can you tell me why you did that ...?did any body should sent request for RFE? did VSC aske for RFE when did you prima facie expier idid see that you file in november ..idid file mine november 5 and 2 week later they request RFE good moreal character and they send me prima facie wich is expier in july and i dident her from them since but i did talke to my attourny and he told me that if we didnt her anything by augest he well call the specail number for vawa unit or writ aletter to VSC .. you i should do like you since we file at the same time

I just wanted to let you know , guys, that I got renewal of my driver's license today based on those 150 days stated on my prima facie letter. They asked me a couple questions about that letter because they did not have an idea what prima facie is nor means... So, I'm very blessed to have my license for 5 more months from today. (Just in case, I live in south florida, maybe driver license's law are different in each state or county)

How's everyone doing? I hope to hear some good news. If anyone can answer this question for me, I would really appreciate it. If one needs a certification or declaration from a doctor/therapist/priest, for proof of abuse does one have to tell them of their "status"? I went to see a therapist in 2006 until 2007 and talked about my "marriage situation" but did not tell her that I had a pending petition. I received an RFE last week and I need declaration from her. Does she have to address it to USCIS? I just can not talk about my "status" and what I went through these last couple of years.
