Ok so.

I Returned home to Ireland from the USA 3 weeks ago, Our I-129f form was approved on september 10th 2008. So i decided when i got back i would call and look into it. So today i was reading up on the K1 process and i read this.

# 1. The US Citizen files the I-129F petition for the foreign fiance(e) with the USCIS. The I-129f is filed at a USCIS Service Center in the US (where you file depends on where you live). The petition phase is very straightforward. Approval timelines vary with each Service Center, with the processing times ranging anywhere from one to five or six months. Go here to see a list of current processing current times.

# 2. After the I-129F has been approved, the petition is sent to the Department of State's National Visa Center (NVC) where it is processed and forwarded to the correct embassy and consulate. The process of sending the approved I-129f from the Service Center (through the NVC) and arriving at the embassy takes about a month. The fiance(e) has 4 months from the time the I-129F was approved at the Service Center to obtain the K1 Visa at the US Consulate in the foreign country. This time period can be extended by a consular officer if required.

that sentence has totally thrown me off, Was i supposed to go to the US Embassy here in Ireland to collect something???

When our I-129f was approved we got a Reciept Number to check our case status..... we have been checking it on a daily basis since september and it STILL says the same thing.

You are confusing "receipt" with "approval". The notice you got in September was only a receipt. The four month clock and everything else you've listed above begins when the petition is "approved". You're still waiting for petition approval.

according to your timeline you received your noa1 on september 10th.

this statement refers to the validity of noa2s. they are valid for a standard length of 4 months but, as krikit pointed out, are extended as required if the case is still open. you don't need to worry about this stuff until you have your noa2. :)

The four month notation is standard wording, the consulates have the authority to extend the petitions validity. Contact DOS Visa services and check up on case status, you will need the DOS case number (Begins with DBL) if you dont have the case number, contact NVC and ask.

First check case status here: http://www.uscis.gov/portal/site/uscis (Enter petition number in the box in the right column)

If it has not been approved yet, then sit tight and wait.

The Dublin Embassy will have no info on your file until about a month after you get your NOA2 which may not be for another few months. So no point in calling.

In the meantime check out the Guides and the Vermont September Filers Thread. You'll be able to talk to and keep track of other people at the same point of the process as you.

This is what happens when you listen to the government. When your petition was approved, it was sent to the NVC and from there to the consulate in Ireland, itarrived about 3 weeks later. There is nothing for you to "collect" except the visa. You must make the interview within 4 months from when the consulate recieved the approved petition.

If you did not, you can file for an extension. I have to say (sorry) but I NEVER understand why anyone in this process looks at a government website and basically sits back and does nothing. Waiting for the government to do it for you??? Yeah, right.

When you file an I-129f, IMMEDIATELY go to the embassy website and download packet 3, DO NOT wait for them to send it to you. Get ALL your documents ready for the interview. When you receive your NOA2, wait two weeks and start sending an email every day to the embassy and ask if your case in there. When they say it has arrived (it will typically be 3 weeks or so) call IMMEDIATELY and make an interview appointment because you have wisely used this approval time to collect all your interview documents and you are READY.

DO NOT use a lawyer.

Government timelines and updates are completely useless. COMPLETELY useless. My wife has already received her GREEN CARD and the USCIS says our I-129f case is "received and pending" (I just checked it) and the packet 3 has STILL never been delivered to our flat in Donetsk. I think about the time we lift conditions the USCIS may update our petition file.

Other examples? No problem, just in our case, which went very easily really. My wife got her AP and EAD 1 week AFTER she received her green card! Duh!!!!!! We don't NEED it now! Some members here have gotten letters that their case was sent to the embassy only to find they were still in NVC 5 weeks later. You have to stay on top of this yourself, or more correctly your USC fiance does.

It's a mistake to presume that all Consulates or Embassies use the same process. What is applicable to one is not necessarily applicable to another. In addition, it is not necessary to file an extension on an active case. Active cases are automatically extended..... it is not something you need request.
