hello all!

my partner and i having some trouble figuring out if we should get married in peru, go with a k3 or cr1 visa, or go with a fiance k1 visa and get married in the states. we want to live there, as i plan on going back to school.

not to be a bother, but i was hoping to get some advice on why you chose to do k1 and how it's going? how's the affidavit of support? basically, since i've been living in and volunteering in peru for the past year +, i don't have a job or income in the states. i'm planning on going back to grad school in fall 2010(which provides tuition and living stipends, but i don't think that can be included on the i-864) and my partner plans on joining me (assuming all the visa things go well). my parents have agreed to cosign. i also have assets....given all this information, would it be a good idea for me to go back to the states and work awhile before the next tax filing season so that i can put my income, etc on the form (assuming i petition after april 2010)?

basically, i want to find a way that we won't get turned down based on the affidavit of support...but also a way that keeps us from being separated for long periods of time.

also. what is the 125% poverty level now-a-days?

any advice?

Choose the path that best fits your priorities. Financial requirements don't vary with visa category, so it looks like you'll need a co-sponsor/joint sponsor anyway. Perhaps your smoothest path would be to marry in Peru and since you're living there, file for a CR1 visa as DCF. (Direct Consular Filing) Check the appropriate Embassy or Consulate's website for the direct filing requirements or contact them directly.

Well in the end its up to you on what you choose and what is best for you, but the reasons we choose the K1 over other visas, are its supposed to be a bit faster, plus with the fiance visa, the first year of our marriage will not be spent apart.

if your parents have agreed to cosign you should not have a problem with either the k-1 or k-3. And they can still be cosigners even if you dont work for an entire year. For example. in 2007 I was a volunteer and made about 2000$, but last year, 2008, I did a part time job and then later in the year started a full time job, which I'm still at. To cover all basese, I am still using my parents as cosigners. They are ok with it, and so I am, and it takes a lot of stress of the financial aspect of the visa.

Also, we applied for a k-1 because:

1)it is faster

2)as said above, we didn't want to spend our first year married apart

3) a long engagement didn't seem so bad (gave skeptical family and friends LOTS of times to come around)

4)my mom would've cried had i gotten married in nicarauga :blush:
