hello!

i have a question about the k3 affidavit of support i-864...since i've been living in and volunteering in peru for the past year +, i don't have a job or income in the states. i'm planning on going back to grad school in fall 2010(which provides tuition and living stipends, but i don't think that can be included on the i-864) and my partner plans on joining me (assuming all the visa things go well). my parents have agreed to cosign. i also have assets....given all this information, would it be a good idea for me to go back to the states and work awhile before the next tax filing season so that i can put my income, etc on the form (assuming i petition after april 2010)?

basically, i want to find a way that we won't get turned down based on the affidavit of support...but also a way that keeps us from being separated for long periods of time.

also. what is the 125% poverty level now-a-days?

any advice?

there are people with no income, as long as you have the co-sponsor that meets the income levels..you should be ok.

google poverty levels 2009, and you will find them

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

There is no need for you to go back if your parents will co-sign and have enough income. You won;t even need the assets. Many people have a co-sponsor, there is nothing to worry about there.

What 125% is depends on how many people will be in the household.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, but there is no "cosigning". You and ONE parent each provide an affidavit of support, the I-134 for a K visa and I-864 for any other spouse visa.

Facts are cheap...knowing how to use them is precious...

I have read so many issues on the affidavit of support that my head is dizzy...:) I spoke with my attorney this morning and what he has told me and what I have read is two different stories.

I have been divorced twice, Two children from my first marriage and one from the last marriage. I have only my last child as a deduction I have claimed every year on my taxes. The other two are claimed by there mother. I have joint custody on all. So that said and what I have read I would claim a total of 5 person's for my household. My lawyer states I only have to claim the one I use on my tax return... now I am more confused.

I am self employed and last year only showed an income (net) 34,000.00, Has anyone ever had to deal with children not living with you or claimed as dependants?????

You claim one child, making your household size three. You can also answer with a household of five. You qualify either way.
