"Hi all.

I would like to know exactly what form do I need to send with N 400 or just the N 400 form and thats it !! plus i dont have a job so far but i am going to file for tax return but at the time i am filing for my Citizenship that i will have 2 years tax return .is that ok 2 years or has to be 3 years!!. now when u receive the Interview letter for the N 400 u will be asked to bring some "evidence" can some one scan this letter for me or tell me what the USCIS ask u to bring!!

You need the N400 form, a copy of both sides of your permanent resident card, a check or money order for the fee, and two passport pictures . Depending on your circumstances, you may also need to send some other supporting documents. Or, according to some, you can bring the supporting paperwork to the interview instead.

Since you only have tax returns for two years, I don't see how you can "produce" a third one. So just bring what you have, and explain why when asked.

I don't know what you mean for someone to scan the interview letter? What is the purpose of scanning? You should keep your interview letter for sure because you need to present it before the interview (as far as I know).

Sand, I assume from your timeline your are filing "marriage based/3 year" The USCIS would expect to see joint tax returns for you and your spouse - if you cannot provide joint returns it could possibly raise some questions regarding the legitimacy of your marriage? If you are not currently working, they would still expect your spouse to be claiming you on is/her tax return. If you don't have three years tax returns, only two, then you can only take what you have. The I-864 is totally irrelevant to a N-400 application - they are not looking to see what your income is, but rather that you are paying taxes on your income, as is legally required, and, that your marriage is legitimate.

The type of evidence you may be required to provide at your interview will be along similar lines to what is required at a I-751 interview - ie joint mortgage/rental agreement, joint utility statements, joint bank accounts etc. If you search the website for info on Removal of Conditions, you can find more details.

Like AusCal stated you need to provide them with Joint Tax returns. And on your tax question by the sounds of it, it's doesnt seem like you have been filing your taxes before. :huh: . Has your wife been filing taxes for the both of you for the past 3 years?

Yes she does file but not for me Just for her.. and by the way the reason that i never filed because i dint work since i arrived to the USA .. i went to School and then to the College. so i dint work to file for tax return..

Did your wife at least file "married, filing separately (and declare you for a deduction?)" I would suggest that you start to file jointly - to avoid raising any questions by the time you are eligible to file fro citizenship

You can never claim a spouse as a dependent. If you file separately, you get to claim your own personal exemption, but not your spouse's. If you file jointly, the two of you get to claim your two personal exemptions (not quite the same as a dependent). See http://www.irs.gov/publications/p501/ar02....ublink100041821 Note that, under "your spouse's exemption" it says "Your spouse is never considered your dependent".

It sounds like Sand's wife paid a lot more taxes than she would have paid if the two of them had filed jointly. But perhaps not -- it does depend somewhat on income and other individual situations. If the couple paid a lot more money to file separately, I agree that the investigator might wonder why.

Ha, always filed a joint return even with my ex that never worked a day in her life, your spouse does not have to be working to file a joint return. Just one example, you cannot claim college tuition costs for your kids with the form 8917 unless you are filing jointly. With WI state income tax, lose many more deductions unless you file a joint return, but not permitted to file a state joint return unless you filed for a federal joint return as well.

Since you were going to school, your wife not only lost you as a deduction, around 3,500 bucks, but could have deducted your tuition expenses as well if she filed jointly. She must like paying additional taxes.

Key motivation for filing jointly is to make the USCIS happy, was advised by attorney during the AOS stage to read all about the I-751 and the N-400 and prepare for that. That is very good advice.
