2 citizenship, overstaying... longer?

Hello everyone!

I am brazilian and I have italian citizenship. I overstayed ( over 180 days, but not too bad. My visa expired in september and I left in May/08) I tried to get back using the another passaport ( the italian one. I thought it would be ok to get back) but I had my entrance refused. It was in August.

Now I am filling up all the process for the k1 visa, but I was just thinking if there was anything easier and faster to do. Like, how can I get back to the waiver program with the italian passaport and go back to USA?? Is the k1 visa faster/easier in that case??

I really wish I could go back to USA tomorrow to be with the love of my life. I am in deep depression bc I miss him way too much, so if you have any advice, anything you could help me out would be really helpfull.

You could have a couple problems. Although you may think the overstay was "not to bad," the USCIs maay not agree. The fact that you tried to reenter the country on the Italian passport end were refused is probably an indication that you may have a problem.

Your love of your life is the one that is going to have to the K-1, but you may have a very hard time proving you have a genuine relationship and you are not trying to use the K-1 just to gain entrance into the USA, which admittedly you are.

Better have your fiance get a immigration lawyer. If you overstayed for more than 180 days you are subject to a 3 year ban from entering the USA.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
