Hi, I'm hoping/expecting our NOA2 in the next couple of months. Because I returned from the Peace Corps at the end of December, I don't have a job yet, and I'm thinking of returning to school next year, so it's likely I won't have one in time for the consulate interview (which may require the I-134) or maybe even in time for our AOS filing (which will require the I-864).

The I-134 form instructions (which reference the I-864 form instructions) indicate that if your income doesn't meet the 125% of poverty level, you can make up the difference if you have investments, savings, etc. which are 5x the amount your income falls short. The current poverty level for 2 people is about $18k right now, I think. I have well over $100k in savings and investments.

So my question is: Will this work? Has anyone else done this?

I know I could get a co-sponsor, but it seems like I shouldn't have to if I have plenty of other resources. Clearly, I will if I must.

I'm just seeking to hear from people who have done this. Also, if anyone else who has interviewed at the Casa consulate can confirm exactly what my fiance will have to bring with him. The Casa page on VJ doesn't indicate the I-134, but it does refer to form 156k which says we must attach Evidence of Financial Support. Does this mean we attach the I-134?

Thanks! Rebecca

Your assets will be counted and it appears you have plenty. The I-134 is not absolutley necessary, it is a convenience form. You MUST show means of financial support and the I-134 is an easy and universally accepted method to do that, I would suggest using it. You can state your savings and other assets if you want. Anything stated must be supported by evidence attached. For savings include a letter from your bank stating current balance, date the account opened and deposits for the last 12 months. For other assets you must include, for example, statements of accounts for investments, etc. You cannot just say "I have $100,000 in the bank" or "I have $200,000 equity in Real Estate" you need to support it. Also, always include the previous years tax return. Other than that, you will be fine.

Thank you both Yassine and Gary, for finally answering me. I was feeling a bit sorry for myself that no one had responded!

I will prepare the I-134 form. I will definitely get together letters from my bank and investment information. Do I need a special letter from my bank, or would the final year statement which shows January 1 balance and December 31 balance work? Or, if I just provided annual statements for several years? (Or I guess, re-reading your text, Gary, I should just ask my bank to send me a letter setting forth what you suggested!)

I'll also get copies of the taxes. I'm still considering asking my brother to co-sponsor, but I'd rather not bother him!

Thanks again very very much!

Also, the assets must be readily available to turn into cash, without causing hardship.

Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members. You may not include an automobile unless you show that you own at least one working automobile that you have not included.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Are stocks and mutual funds good? I don't mean money in Roth IRAs or any IRA or 401K. Just straight investment accounts.
