I married in August of 2008, however, I forgot to change the filing status on my w2 from "Single" to "Married". Should I be concerned or it's ok, as long as I file my 2008 taxes as married. Also, what would be the best filing status, filing jointly or filing separately? My wife is still in Pakistan, and my case was just approved last week. Any help would be appreciated.

As long as you file your taxes as married you should be fine. Being single just means that Uncle Sam takes more of your money. I still claim single (even though I am married) and my spouse and I get a nice check in February of each year. You get the biggest deductions if you file married 'jointly'.

It dosen't matter about the W-2 although they will continue to withhold at the single rate and your check will be a little less than it you changed to married.

Filing jointly usually saves the most on taxes. You will need a ITIN to file go to the IRS website and download form W-7 and send it in with your 1040.

But considering the time it might take to get ITIN, can I file separately? Also, along which tax return do I send the w-7 with? 2008 or 2007?
