Hello everyone!!!

What should I do if my wife has an old denied I-485 case base on misrepresentation 212(a)(6)©(i) and we are filling the K-3 Visa process now??

I know that when you file the DS-230 you need to check the YES box if you had a previous misrepresentation case, right? and also if yo do that, I think they will immediately deny the visa, right?

Please give some advice on how to proceed with this case.

I'd check with a GOOD immigration lawyer. FYI. You don't have to fill out a DS 230 for a K3. Only a DS 156

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

For CR1: you need DS-230, Parts I and II, for presentation at the time of the visa interview. The Consulate cannot process your case until it receives this form.

For K-3 visa: you need DS-156 Nonimmigrant Visa Application (in duplicate) and one DS-156K Nonimmigrant Fiance(e) Visa Application.

You are right about the forms but it doesn't matter which visa application you fill, you will still need to answer to does questions, if you had a misrepresentation or overstay before. So correct me please if i'm wrong that mean that our visa will be denied anyway, right? or there is a change if I answer NO to those question and when they figure it out that I committed misrepresentation again I will have the change to fill the waiver, right?

Please help me, I don't understand all this process and I need to have my wife here with me.

Misrepresentation is a BIGGY.
