Hi all,

My wife's k3 has been approved, she has an interview on Feb 09, I just called the NVC two days ago, they have also recd the approved I130 and they are now processing it, I am confused now? My wife wants to enter the U.S as a permenant resident, Should she just go ahead and take the k3 interview and if she gets the k3 visa, can she just wait for the I130 to arrive to the consulate also and than wait for the I130 interview so that she can enter the U.S as a permenant resident? She really wants to enter the U.S as a permenant resident but doesn't want to miss the k3 interview either.

I read somewhere in the forum that if the I130 gets approved just before the k3 interview, the k3 interview becomes the CR1 interview. I want to know how does it happen? what's the procedure?

I hope someone has the time to explain.

If she wants to enter as a PR, then you need to follow the I-130/CR-1 path. If she follows the K-3 path she will need to adjust status after arriving the U.S. Look here to move through NVC quickly on the CR-1 path:

CR-1 is a much better visa.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

That's true but yes, she can obtain both visas if she wants. If so, the K3 will be cancelled.

Chalk this up as another case where an I-129F should never have been filed. Captain Ewok has committed to reverse the option 1 and option 2 in the guides for married people so K3 no longer appears as option 1.

If you want an immigrant visa, don't file an I-129F for spouse.

So in other words she can just go ahead for the k3 visa, and once visa in hand instead of travelling to the U.S she can continue the the CR1 visa process, is that what you are saying? coz she doesn't mind doing that.

if she waits she doesn't have to adjust status after arriving with k-3

some cases i129f & I-130 are raising each other

you might also try for a later interview date in hope the I-130 gets done first and swap the interview if the embassy lets you
