Please point out in the I-864 instructions where it says it can be used for a K visa.

Provide an I-134. The $131 fee is the visa fee and has nothing to do directly with any affidavit of support.

i know , i sent the embassy an email regarding the issue and they emailed me the documents required for the k3 visa ,including a fee of 100$ so i assume the embassy staff just sent me their old papers because the fees are no 131 $,the lawyer insists

instead of Form I-864.

Who Completes and Signs Form I-864?

The U.S. citizen or lawful permanent resident who filed aForm I-130 for a family member, Form I-129F for afiance(e), or Form I-600 or I-600A for an orphan.

The U.S. citizen or permanent resident alien who filed anemployment-based immigrant visa petition (Form I-140) fora spouse, parent, son, daughter, or sibling who: (1) has asignificant ownership interest (five percent or more) in thebusiness which filed the employment-based immigrant visapetition; or (2) is related to the intending immigrant as aspouse, parent, son, daughter, or sibling.

That direction is under "Who completes and signs...?" You must first look at "Who Needs This Form?" The K3 petitioner is on the list of people who would complete and sign the form but in behalf of the beneficiary adjusting status, not in behalf of the beneficiary applying for a K3 visa. You'll use the I-864 when she adjusts status.

For the visa, use the I-134. Don't give that attorney more money.

Are you using an American lawyer in Egypt? Or is your wife using an American lawyer in the USA? Either way, I'd fire him.... Ya Salaam! Don't pay anyone who tells you they know more about the process than the Embassy does..

My husband just came here from Egypt in October. I did an I134 for the K1 visa, and an I 864 here when we did the adjustment of status here in the USA after we got married here. You are correct that the Embassy in Cairo sends outdated documents. It makes no sense, it's confusing, and it is downright rotten of them. However if you don't give them what they want, in this case the I134 they won't give you what you want... THE VISA... so cooperate with them and if you really want to cause a stir, (and spend more $$$) have your attorney contact them and they can argue about which form is right and guess who will win???? THE EMBASSY!!!! And more time will have gone by for what???

However, if you really wanted to, you could have your wife complete BOTH forms and you could submit BOTH forms and if you need to do the I864 once you get here, you'll already have all the information!

Good luck to you and your wife!

Yes, you may send your spouse both forms. Why not just tell the lawyer to um, "Go Spit!" He's wrong. Don't give him any more money.

We have a saying here in the USA... "You get what you pay for"... if you are not paying this lawyer, then you got what you paid for... NOTHING... Since when do lawyers in the USA accept clients needing Immigration Papers for FREE??? Good reviews? Reliable in the association? Amazing...

I swear I'm going to set up a paralegal business in Egypt... helping people submit Visa Applications... I bet I'd either be rich, or to stark raving mad...
