hello to all! im new here and have been browsing this site. i have some questions, but first i will tell you our story.....

im from america and met my husband in april of 2006 while he was on a work visa. we dated the whole time he was in america, his visa was expired in october 2006 so he had to return to bulgaria.... and he offered me to go with him. so october 31 2006-nov 14 2006 i was in bulgaria. i returned home and waited until march 2 2007 for him to return on another work visa... in april 2007 we moved in together with a roommate (my 1st apartment) and again in oct his visa was expired.... so i moved back with my parents (the apartments were being rebuilt anyway so i had to move) and again i went to bulgaria with him in oct 2007. in nov 2007 we went to england to visit his brother for a while and in feb 2008 returned to bulgaria. in april of 2008 me and my now husband went to the US embassy in sofia so i could get a paper saying i "can marry a bulgarian in bulgaria". the consulte there asked me if i had any questions and i asked her while i was waiting on my I-130 to be processed what to do, because i didnt want to go home without him, and all she said was "o just stay here!!" and kinda laughed...anyway on october 15, 2008 we were married, we sent our I-130 to vermont in nov 2008. and now just waiting....and in jan i found out my I-130 was transffered to california....

my question is since ive been out of the states for more than a yr will this hurt our visa application? because i dont want to jepordize our application, but at the same time i dont want to go home without him.....

also for the next form that ill need to fill out for the affidate of support i know that since im not working that it will be denied, so i can i just fill out the other form with my step-dad first wihout sending the 1st one and then it being deined? beacuse when we go to the states we'll be living with my parents for a while. they just bought another house this past summer so they said we can rent the old house while they move into the new one...

any advice and gudiance through this would be much much help!! thanks in advance!!!!

You're a US citizen, rkght?

What's important for the I-130 is to show US domicile, and that the visit/stay in another country is just temporary. Anything to show US domicile will help - like a house in one's name, an active bank account, a car, investments, employment (even over the Internet), etc. You can give your parents' home address as your US domicile. Anyway, you already sent out the I-130.

In our case, we used my mother-in-law's house. We also have our mails sent there. My husband just explained that due to extreme difficulties (him being a disabled veteran and me having a diability too), it's necessary for us to stay together so we can take care of each other. Normally, the US petitioner sends the I-130 from within the US while the beneficiary is in his/her country. But there are cases (like mine and yours) in which they lived together in the foreign coountry and submitted the I-130 from there. Well, in our csae we used the US domicile for return address.

The reason why it's important to show US domicile is that the purpose of the immigrant visa petition is mainly to reunite families in US soil.

If you're a US citizen, you're not obligated to be in the US for any amount of time.

If you don't meet the minimum for support, get a relative to sign on to it. Sorry I can't help there though as we're not done with that yet. I'm not sure either if the woman has to show the same proof of support as a male petitioner.

I'm sure more knowledgeable people will be able to give advice to you here. Good luck!

You should be celebrating the fact your I-130 was transferred. It will definately mean a shorter processing time. Your step dad can be the co-sponsor for the support documents. One last note, you can only stay 90 days within a year time period in BG. After that you will have to pay a fine before leaving the country, and I think it's pretty expensive. All the best for you! :)

thanks, and when i sent the i-130 i also sent a copy of my driver's license, so maybe that'll be proof enough of my address?? and all of my mail is to my parents address as well. and when on the i-130 it asked if u lived in another country other than the US i put the address in bg but they sent tthe NOA to my mom's house and she emailed me that so i could see exactly everything.....but hopefully its not a problem!!! thanks much and good luck to you and your spouse!!!! :thumbs:

Well i guess that is great news if the processing time is quicker, but it seems like no1 actually knows for sure!!! and for staying in BG, like i said the counsult at the embassy in sofia just said "o just stay here" and laughed, and i also asked another guy who works in the BG-turkey border, and he said "as long as you guys are married, its no problem!!" and when i checked on websites and asked some other ppl some gave me the same answer that its no problem if married and others said as you have for 90 days, so hopefully if i do have to pay, maybe it wont be too much, but ive already been in BG for a yr on feb 14!!!!! well thanks for your reply and all the best luck for you as well!!!! ;)
