I was IR-1, but one crazy thing that happened to me. I filed I-864 with NVC and my last 3 years tax transcripts. Everything was approved at NVC and then forwarded to the consulate. I supplied 2007,2006,2005 returns. My 2007 was barely over the limit. I owed the IRS $10k at the time. When she went to the interview the gave her 221g saying that since I owed the IRS $10k and I made $18k for 2007 that in reality I only made $8k due to the debt to the IRS. I quickly filed my 2008 taxes and sent it to my wife. I was well over the guidelines for 2008. They accepted that.

I went all the way back to 2006 and filed amended returns married jointly. They sent me a big enough check so we can go to Thailand for Songkran. It all worked out nicely.

So you were married in 2006, but for some reason couldn't file as married?

We're going back to run a study abroad program in May. Planning to stay for the summer. I think I'm going to rent out my house as a summer rental if anyone's interested...

I have another question about the Affidavit of Support I-134 form. I would like to start gathering forms to send my Fiance' for her packet 3. If everything goes right I should get the NOA2 in four to six weeks. Is it too soon to start gathering the financial paperwork like the letter from my employer, pay stubs, etc? If it is too soon when is the soonest I can send pay stubs for example? Thanks!

I have electronic copies of my last three years tax returns (I filed electronically via TaxCut software so it creates a PDF file). However, I like the idea of getting official copies from the IRS. They list two different types of transcripts:

Definitions:

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income.

Do you think I should request the Tax Return Transcript or the simpler Tax Account Transcript?

Also should I wait until NOA2 before sending the employment letter and pay stubs? The Visa Guide on this site says "most recent" pay stubs but also suggests sending them as soon as you get the NOA2. I think to play it safe I'll wait until I get the NOA2 before sending my pay stubs to my fiance' but I'm curious as to what other people have done. Thanks!

Tax return transcript is what you want. Depending on when you have your interview, you might need to show them 2009. You can send the pay stubs and letter later I guess. I get the feeling they don't really care about them. The tax transcripts are the key.

I just printed out my tax returns from Tax Cut, I used an employment letter that was about 2 months old, and did not include any pay stubs. My income for all three years was significantly higher then the requirement.
