As far as whether you are working with the numbers for a household of two or three, I have no idea, since your fiance's son will not be living with you. I would try to call the USCIS and ask.

I wouldn't recommended asking USCIS about this for two reasons:

  1. USCIS operators are well known for giving out misleading information. I would take any advice given to you by an operator with a grain of salt.
  2. The I-134 is handled by the embassy, not USCIS. If you want to ask about this, you can attempt to call the embassy, but they likely won't answer your question over the phone. The embassy generally only answers questions via email and they will only answer questions with a properly formatted subject that includes, among other things, your case number. You should be able to get your case number from an NVC operator once it clears the NVC or just before it is mailed to the embassy.

1st, Does applying for the minor child mean our household income has to be 3, even if we aren't planning on taking him? If so, can I just say 'self-employed' and send in my tax returns (which should be sufficient evidence)?

If you are applying for a visa for the minor child they are considered as a dependent, so you would need to meet the income level for 3 people.

You can't just say you are self employed. You need to have some history of this, if your tax returns show you are employed, and then all of a sudden you are self employed with no tax returns, etc, then this is going to raise a real red flag. Not being employed is going to raise a big red flag at the Bangkok embassy, they are very picky about everything. With all the people out of work in the US, I am sure they will be scrutinizing the income requirements. I also think the guidelines for self employed are different from the guidelines with regular employment, as in what you must provide for documentation. Also the asset multiplier, can be used, but I think there has to be a history of the money or asset. You can't all of sudden have a 100K in your bank account the month before you interview. I am sure it will be asked where it came from, with documentation.

On a side not just because you meet the income requirements, they can still deny you, it is the embassies discretion, and Bangkok is very picky for K1's.

You might want to think about heading back to the US, get a job making more money or get married in Thailand and then DCF, like was suggested.

There are some very good threads on visajourney about filling out the I134, I suggest you read through those. That will give you a lot more information.

Agree with RSN's advise. By getting married in Thailand you will be able to file DCF (check with the embassy first). It is pretty quick and uses the I-864 instead of the I-134, so a co-sponsor would be allowed.

I have not posted here in a while. I am back active, (at least once a week now), on this board as we are going through the I-751 process now. I've had to deal with a lot of strange issues throughtout this process such as assisting my wife in getting a prior marriage to a man in Singapore anulled and getting approval from Amphur for my step-daughter to accompany my wife, (then fiance), to the US.

I don't have time to read through all the posts here, but if I can be of assistance to anyone who's having similar problems, feel free to drop me a note.

Hello All, I just sent out an I-129F :) for my fiancee from Thailand.

This is my 2nd visa journey. I did one before for my ex-wife from Thailand as well, back in 2002 with a K3 and that was perhaps the fastest K3 I bet, I-129F approved in just 2 weeks from mailing it out, then I-130 approved in 3 months after mailing back with approved I-129F but those speedy days are gone. and by the way we divorced completely in 2003 and it was a bad relationship.

this is my first time to do a true K1 visa and it looks more complicated now.

and I guess I needed no evidence since I was married before with the old I-129F, but this time I need relationship proof since its a fianceee this time. I am deaf and I dont use the phone with her, we only chat on MSN and none of the chats are saved and pretty much lost (I constantly have reinstalled my OS a lot and do upgrades) but I take a few screen window snapshots, and we met in person many times, unfortunately the first two times, the photos were lost on my old drive when I lost an Array, and it left me with only 2 photos from my most recent trip in June. and I sent those with the I-129F along with plane ticket copies. oh great I have no idea if thats gonna fly.

Some have well last time I was allowed at the VISA window with my ex-wife for the spouse visa K3 and some say they can call up the USC to the window with I-134 etc during the interview.? Do they still allow that.

I am planning to fly out again once she has a set interview date and go with her to the embassy. Well it would be good proof since they would see me physically and know I dragged myself to Thailand again for her.

Hello there & welcome. The Bangkok embassy was pretty brutal for a while, up until about May of this year, but things seem to have settled down since then. Note that the embassy usually does not currently even let you in the building during your fiancee or wife's interview though. Also, they are pretty serious about having lots of proof of relationship, and even now they appear to be pretty picky, so you will probably want to overcompensate if you want to avoid any problems. I continue to believe that it is very helpful for you to be in Bangkok during your SO's interview, even if you cannot be in the building. She can show them your passport, and they seem to notice that.

Since you have already sent in your I-129F, there isn't anything we can suggest as far as evidence, so you'll just have to wait and see if you get your NOA2 or a RFE. At this stage, you only need to prove that you met in person within the last 2 years, which it seem you have done.

As for the interview, the fiance or spouse are no longer allowed inside the consulate. You can do as Ray suggested and hand your fiancee your passport before she goes inside, but that's about it.

Well I guess I will go that way, dont mind if I cant be in building, but gee its gonna be a bit hard being too close to Wireless road (the scanners, they are plain cloth Thai people that are around 20-30 years old they go snapping photos of you and everything and report back to the compound) :D

But I will bring along my new passport (only has one stamp and was received this february) and my old passport from 2000-2008 which has ahem.... 41 stamps to Thailand :D

Scanners? Is this around the US Embassy? Do they work for the CIA or the Thais?

This is the first I've heard of them but I'm just starting out so there's a lot to learn...

Part of US Embassy Security Services, they outsource everything including the armed security to a security firm (the marines are part of the true embassy security) but the ones on the roadway, the visa services, the post office, and the other offices accross from the real embassy are outsourced. I think last contract was with SECURICOR. the scanners are just to look for suspicious people who might be standing too long around the embassy and they just document records. Its common stuff that security would conduct as an extra measure

Since you have already sent in your I-129F, there isn't anything we can suggest as far as evidence, so you'll just have to wait and see if you get your NOA2 or a RFE. At this stage, you only need to prove that you met in person within the last 2 years, which it seem you have done.

I tried that. All that said was that I proved that I lived in Thailand for 3 years. It didn't prove anything about me living with her. Take alot of photos.

Some bonehead caused a problem a few years back so they don't allow the USC into the interview any longer. That said, if 221g is issued they will allow the USC in to provide more evidence.

Does anyone know of the updated packet 3 forms you can download? I heard somewhere that the ones on the BKK embassy site are outdated, and heard that some couple actually has a site that shows the more updated forms, so I can make rough drafts early but I can find a link yet.
