I was about to file a K1 but I'm getting reluctant to do so due to to the IMBRA holdups. I had planned on spending a few months in Brazil after September anyway with my fiance. I'm wondering if I can do the DCF thing from there after marrying in Brazil. But the information I can't get out of the consulate (after 3 calls) is who is considered by them to be a resident of Brazil. If I marry and am waiting for my RNE card and stuff, do I count as a resident?

...I'm getting pretty confused. Anyone done this/know someone who did this?

Thanks in advance,

Alex

Alex, residency requirements were tightened up in Brazil a couple of years ago. Therefore, we dont' see a lot of non-resident reports. However, their website leads me to believe that it coiuld be worth your while to pursue.

Have you tried sending an email to the IV Unit?

Be sure to read the DCF Guide before you do so; make sure you understand what you need to know, and how to find it out. "DCF" is not a government term and they may not recognize what youa re asking.

Hmmm I hadn't tried that IV Unit thing yet. I'll try one more time to get through to them tomorrow at the designated 2 hour period (today is 'Corpus Christi' Day). If not, I'll do that. Thanks. But as the new I-129F is out today... not sure.

we once talked with a lawyer in brazil. He said if we were to marry in brazil I could become a resident. You would need to register the marriage and fill out some paper work. It is definatly worth persuing!

Why did you decide not to do that? What else did the lawyer say? Thanks!

well we had already applied for the k1. if you look at my timeline it took 6 months to get the approval. I was in brazil for 4 of those months and we started to worry. We were considering canceling our i129f petition and doing that route. I am glad we didnt though because a few weeks after we got the approval.
