F-1 Visa after AOS

Timeline

My wife has a F-1 student visa and we already filed the AOS documents(married and filed AOS docs Dec 2008). We got the Notice of Action receipts(I-485, I-765, I-131 & I-130) on January 6, 2009 and did the biometrics today 1/31/09. Would it be a violation of her F-1 visa if she quits school or reduce her hours from 20 hours to say 12 hours?

We are worried that she will be deported for not doing the required hours of the F-1 visa, or we shouldn`t have to worry about that because we got the Notice of Action receipts.

Can she legally stay here without going to school, or does she still need to go to school until she gets the EAD document or card?

Nope,

The moment your filed for AOS and received the notices of actions, she is no longer an international student but a foreign spouse adjusting status.

Don't worry mate, she is free to drop her full-time status ;) just take all the NOA's to international programs and explain your situation ;)

Yes, don't worry about it! She doesn't even need to take any classes too, and can stay in the US.

But remember, do not leave the country until you get the green card or the AP documents!!

11/12/08 AP Approve Notice Sent , EAD Card Production Ordered

11/17/08 AP received

11/25/08 EAD received

12/11/08 Appointment for Interview - APPROVED

12/27/08 GREEN CARD received

11/16/10 USPS Express Delivery I-751 to California Service Center

11/17/10 USCIS received the package, Notice of Action dated same day

hi,

She is your wife now and has her AOS pending. She can quit school any time she wants. Just wait for AP if you want o travel.

I also recommend that your wife goes to the international student office and let them know about her status change.
