Coming back to USA from Europe

Timeline

after 2/3 month vacation with:

- valid European passport

- 2 yr GC expired

- I-797C NOA (Notice of Action) in which is stated "your conditional resident status is extended for a period of 1 year........."

Can anyone be so kind, accordingly to his/her personal experience to write just a note about how it was through the Custom the return from Europe, as in about 5 weeks I'll be going on vacation to my country in Europe, and I'll be returning to the USA in May.

K1 VISA: 07/25/06 GOT VISA!!!!!!

30th of September 2006 WEDDING

AOS:01/29/2007 received Permanent Resident Card (GC)

ROC:04/11/2009 received Permanent Resident Card (GC) expiring in 2019!!!!

N-400:

on 05/21/2010 Sent out docs to Arizona Lockbox Facility address via USPS

on 06/30/2010 Biometrics

on 09/24/2010 Interview Day - Passed the Test

on 10/19/2010 Oath - USA CITIZEN!!!!!

on 10/20/2010 I requested the US Passport

on 11/02/2010 the US Passport was received by Priority Mail

on 11/03/2010 @ the Social Security Office I changed my status from Resident to US Citizen

ON THE 3RD OF NOV.2010 MY JOURNEY ENDS, WHICH STARTED IN DEC. 2005!!!!!!!THANKS TO VJ & VJ PPL!!!!!!!!

I don't have a personal experience, but you should not have any problems with your expired GC and you 1 year extension letter returning to the US. I am sure someone has an actual experience. Customs is aware of the NOA, 1 year extension letter. It will be the same as if you were traveling with your GC and it was not expired. My wife has returned home twice with her GC. Good luck.

In December I had to go to Dubai and back, Italy and back and Moscow and back with my expired green card and I-751 extension.

No problem whatsoever at the POE and while boarding the plane back to the US.

Surprisingly, everybody knew what the extension was.

Very smooth!

Well...If you are really worrying about coming back, you can always bring you round trip flight tickets or receipt for purchasing those tickets to USCIS, make an info pass, ask them to stamp a I-551 stamp on your passport, so in case you lose the extension notice, you still have that stamp. I mean if you have time to do that, it'll be good. But if you don't have time, just the extension notice is fine. :thumbs:

7/2/2010 - Called mis-information line to put in a service request for STILL HAVEN'T RECEIVED "FP NOTICE"

7/8/2010 - LUD, at 2:32am, received text msg and e-mail for req. for add'l evidence being mailed out on July 6th, believe it's for the FP

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

I came back at Christmas with no problems with the extension letter and GC. Once you get back to USA go to the US line for passport control.

I-751 Divorce Waiver Timeline

02/03/09 - Submitted I-751 package to USCIS Vermont

02/04/09 - I-751 package delivered to USCIS Vermont

02/06/09 - Check deposited by USCIS Vermont

02/09/09 - Received NOA that I-751 was accepted (Extension of green card)

Timeline

I went to Belgium for two weeks during winter holidays to visit my sister and I had no problem :D .

My case was even more complicated because my romanian passport is on my maiden name and everything else (plane tickets, GC, NOA) was on my married name. Because of that I also had to have with me the marriage certificate. So do not worry!

Tks all of you guys for yr replies, and yes Viky it will be the same for me, although in my italian passport I requested to put a little notification with my married namme, too, but I have the ticket flight with my maiden name anyway, so as you did I was thinking to bring with me my marriage certificate in original.

HI, just came back from my vacation, simular situation. however, they did transfer me to the "room" wih the officers to check on the status. spent there waiting about15-20 minutes or so, few questions asked to check if it's me, and free to go=)

however, have all papers with you that might be helpfull, also stamp your passport (if there is time left, otherwise, dont worry, I had no stamp)....

However had friend with the same thing travelling... they were transferred to the "room" also, but spent there much longer and had to deal with officers for a while, answering thousands of different questions.... just as an interview...

My advise: act friendly and SMILE =)
